A faulty camera, please help!!

For Christmas I received the fujifilm XP30 camera which advertised to be waterproof/ shockproof and freeze proof which I thought would be great. Using the camera for the first time in January it broke so I took it back to comet asking for another camera and the camera hasn't done what is promised me, they disagreed and stated they could on repair even though I had the receipt and all the box etc.
Anyway.. I received the camera back and still the quality wasn't good, but I kept with it, I went on holiday last week put it in water for the FIRST time and it's broke. Been to comet again they are refusing the give me an exchange and said I may have to pay to have it repaired & if I do get it repaired I will still have to have the same camera (which I have found isn't reliable)
Can anyone tell me what to do from here please?
P.s look type the camera in on YouTube you'll see why I'm so disappointed and annoyed with comet the manager said I shouldn't of put it in water?

    Product says it can shoot underwater!

    Personally I doubt an £90 camera is robust enough to be able to shoot under water! Therefore I thinks, Misleading!

    Mind you, if OP is a deep sea diver, ....

    This is a camera that I looked at but it had very poor reviews regarding picture quality.
    As for the Comet manager saying you should not have put it in water if that's the case then they should not advertise it as being waterproof to a depth of five metres.
    If it's faulty take it back and get them to sort it out but don't expect great picture quality from this camera.

    Have you contacted fujifilm at all?

    They may either swap it for you or at least give you a reference number to take to comet as proof it is not up to standard.

    The other problem you may run into is that you have no rights at all, it is the person who purchased it for you who has the SOGA on their side.
  • So technically am I not entitled to exhange for another camera? I'm going to ring them tomorrow and see what they say. I did tell the manager that and he laughed at me.

  • Ok, so it is not as advertised. TGherefore it is not fit for purpose. It now depends on when it was bought. If it is less than 6 months, the onus is on the retailler to provide recourse. After six months, it is for the owner to prove it is inherently faulty.

    You should have rejected the camera in January as being faulty/not fit for purpose/not as advertised, then you would have been entitled to a refund - you have a "reasonable time" to reject an item.

    After "a reasonable" time has elapsed you are deemed to have accepted the item. Then you could only claim replacement/repair.

    Within 6 months of purchase, the seller has to replace/repair unless he can show that the item was wasn't faulty/not fit for purpose etc

    After 6 months, the onus is on you to show that it is faulty/not fit for purpose/not as advertised.

    But it sounds as if you may be to show this. So push for replacement/repair providing all the evidence.

    Just a thought but the repair may have caused the camera to not be waterproof anymore depnding on how much they took it apart. If they want to charge you for the repair it may be worth having the camera inspected before returning just to see if this is the cause.
  • What makes you think you're entitled to a replacement?

    They're allowed to repair, you're not automatically entitled to an exchange just because something is faulty.
  • There is no need for some people to be arsey I would prefer you not to comment if you believe I am not entitled to what I want. I believe you are totally wrong though as overall the product has not achieved what it has promised yet again I have had another holiday with no photos so when it keeps breaking it needs to go in for repair , what a reliable camera ay?!
