The trouble is the policy says under claims "You must settle, negotiate or agree to pay any claim without our written permission" Im just sick of the whole thing tbh.

Thats great thanks. I was just worried as I spoke to a solicitor tonight that I know and he told me just to check the small print. What would be the worst that happens if my Insurance co throw a hissy fit?

The only hissy fit they might through is as they will lose the commission that Drive Assist pay them.
If in the unlikely event the other person claims against you, it can cause them problems which is why the wording is in there to protect them from policyholders who interfere when there's a claim against them0 -
Great thanks for the replies. As you can tell I'm new to all this, I'm just glad I smelt a rat before they removed my own vehicle from my possesion and dumped a rather expensive hire car on me. I'll see how I get on tomorrow as regards talking to the other party's Insurance co.0

You can find the Insurers name, policy number and their tele number for £4 here https://www.askmid.com
When you ring the Insurers ask if they have an "Innocent Third Parties Dept" or a department that deals with third party policy holders.
Mention you have DA sniffing around which will make them take notice0 -
Thanks one last question do I have to inform my Insurance co of my intentions or will the other party's Insurance co do that for me?
At the min the claim is on hold with my own.

May be worth telling them you're handling it direct.
When you receive any letters from the other Insurers accepting liability or confirming they're paying for repairs. Send a copy to your Insurers and ask them to note their files the accident is non fault as you've recovered your losses from the other party0
