Miss Sold Tesco Mobile Contract?

Hi, i am after some advice please.

And before anyone says i am just trying to get a free phone, i am not. Firstly i have paid £240 for the handset and have been with Tesco mobile for 6 of a 12 month iphone contract.

When i took out the contract i was told by Tesco Mobile the network was the same as o2 in every single way, other than the person i pay - which is Tesco instead of o2 of course.

But this is far from the case, first of all i noticed call waiting wasn't a feature they support which i couldn't get my breath over to be honest, but was willing to let it go, now i have recently found out i am unable to use the personal hot spot or tethering function either, which every other network, including o2, in the UK offer. For me, these are two big functions and pretty basis functions that Tesco are not offering for one reason or another, and i seriously feel like i have been lied to with regards to the Tesco Mobile network.

I have recently bought a wifi Ipad, which i opted for as most of the time i would use it in the house, but if on the odd occasion i used it out of a wifi zone i would be ok because i can connect and use through my phone - but now found out this cant be done. I want this contract ended and i want to switch providers.

have i got grounds on anything at all?

    On our Orange business contract 4S's it disabled also but can be enabled for an extra charge I believe.

    It all comes down to what you can prove. Is there anything on their web site that says they provide these features? I suspect not.

    Is the sales person willing to come forward and say that they told you that Tesco mirrored O2 100% in what they provide?

    Have you got a totally impartial 3rd party who can confirm what you were told?

    Did you sign a contract that included a phrase similar to "I have read Tesco Mobile t&c and agree to them"?

    Without any hard evidence, you have a hard job finding any reason that would stand up for cancellation. (I am quite willing to believe that you were misled, but as I said, can you prove it?)

    Especially when it comes to the tethering feature of the iPhone. It is something that is enabled as standard, and requires the network to specifically disable the feature for it to be unusable. So certainly in that regard I would imagine you have something to stand on anyway if they don't say the plan excludes tethering.

    Most places offer tethering as part of a paid for package. There are a few that just don't offer it at all, and I guess that's down to them piggybacking another network. Otherwise it's paid for in the contract, or on top as an extra. It is not the norm to have free tethering, unless you do it against T&C's and risk getting caught, basically!


    02 needs a bolt on

    Vodafone maybe if you pay extra to begin with in your package, otherwise a Via your phone plus tethering pack

    3 Mobile = Yes on the One pack (again you pay for it inside your contract cost; or extra for an Add on.

    those are a few examples, but it's all now part of the T&C's of which you should read. Tescos implicitly say no tethering at all, at all. People don't read them, thus when they complain when they don't get what they want, they look a bit daft. Certainly you don't believe anyone who is effectively a sales person, and they're generally not good at it either. You have to check it yourself.

    Tethering, alongside Data, is now something that people need to consider in new contracts, and thus should be explored before you agree to it.

    i would be quite happy to pay an extra charge, currently i have 1gb allowance, i would happily pay the extra £10 a month to get 2gb if i were allowed to do what i wanted with it, instead of being restricted.

    I genuinely am not causing fuss to try and get out the contract, im happy with it overall but have got seriously !!!!!! off with the fact im being so restricted on what i can do. I have heard from someone @ Tesco mobile there are some android users that get access to this because they are unable to disabled it on the android software, how is this fair?

    To me, call waiting and internet tethering are basic functions, i should have been told there not included and told Tesco don't offer this functionality yet. Searching on the internet an artical back to April 2011 there is a boss @ Tesco saying it would be 'available soon' yet 15 months later it still isnt?

    Look - I have not read Tescomobile t&c as I don't want to use them at present, so I don't know what is contained in them.

    I was answering the question about grounds for cancellation and OP needs to read the t&c to see if there is any reference there to what he needs/wants.

    The thread is headed Miss Sold Tesco Mobile Contract?. Now I suspect you know that this is hard to prove without hard evidence and that was my comment. OP should see if there are any get outs in what is in writing. If not, then proving mis-selling will be very hard unless sales person admits as much.

    I have to say that there is a big difference between mis-selling and mis-buying due to lack of pre-purchase research.
  • I tether my iPad to my Sony Xperia with no problem at all on my 1gb data element of my plan.

    Aware of the condition but it's a fixed data plan I'm not using it for any more than rare Internet and so far for very little data 20mb.

    Is this actually a problem?

    Sorry for the thread hijack, but what is the rule for tethering for Tesco Mobile on a standard Sim-Only deal.

    I've tried searching but the answers from Google are "yes you can" and "no you can't". I could connect my Nexus 7 up to my phone via Bluetooth to make use of the phone signal to access the net (as I found out today when bluetoothing over a picture)

    Most high profile companies are professional and if the OP just appeals to Tesco in the same grounds as they did here, Tesco might just roll over and either set them free or offer the additional services

    So my answer would be to tell Tesco what you said here 1st and see what they say

    Too far into the contract, I would say, but, nevertheless, anything is worth trying, as long as you make a clear case and also explain why, if you have done without the facilities for 6 months, you require them now.
