    Just as a matter of interest, OH's (24 month) contract does not expire for 3 months. Will he be charged fee/penalty for early upgrade, given upgrade now is being proposed by Orange not him?

    Also ditto if he lets it lapse and starts again? (Reason he could do this is he also has an old PAYG phone with Vodafone)

    Normally, Orange don't charge for upgrading only during the last 45 days of the minimum term, so it all depends on what you agree over a phone.

    I don't quite understand you mean by "lets it lapse and starts again". Of course he can wait until the min. term expires and to upgrade then or even buy a new contract. The closer he is to the end of the min. term the better retention deal he is likely to be offered.
