    lastly, although the police are going to be dealing with this, it will take time for him to possibly br prosectued, and my faith in the police is not high. I deleted the pm's from last night as if they cant post openly then im not interested....x

    Exactly what you should do with pms like this, I assume they were going to tout for personal injury claims from you.

    The police prosecution won't make much difference to your claim, there's a chance it won't go ahead anyway. It can take months for them to send a report to the Insurers / DAS.

    DAS will just use normal civil court processes to deal with the claim against the other Insurer, claims are normally settled without going to court as defending Insurers don't like wasting money on court costs if they know they are liable.

  • I had an accident with an insured car that was not driven by the insured. I had similar promises that the insurance company could get the money from the insured, 11 months on and it is still being sorted, so prepare for a lengthy ride. It all depends on who the police prosecute as to who will pay and if the police manage to prosecute anyone at all. You are in limbo until the police have done their bit. I tried phoning solicitors and insurance companies weekly but sadly it made no difference at all. Everyone needs the police report before they can ascertain any fault and police reports take time. Sorry, but save yourself the stress and try and forget it for a few months, it may not seem like it but putting it to the back of your mind is the only thing to do or it consumes you and Im speaking from experience.
  • Could someone explain what the difference is between RTA insurer and Article 75 insurer please?
