    DAS would not give out a credit hire car unless if they were pretty confident of recovering the money.

    There's nothing to stop you requesting an estate car for the duration of your holiday. In fact as you had an estate car before the accident, you can request an estate car for the entire period.

    Do you know whether DAS have given you the waiver not making you responsible if they cannot recover the money. If not ring them and ask them to confirm it in writing

    yes they were confident when i told them the story and the false details... thank you for your help. i didnt know that i could ask for an estate. i will call them tomorrow and update you.

    i have had a couple of pms tonight saying that its the car thats insured third party even if the driver isnr insured, is that correct?

    If you're getting PMS from people touting for business, please ignore them as it's against the ethos of MSE.

    I would also be suspicious of any unsolicited advice you get from PMs as if the people are not confident to show it on these boards for scrutiny then the there's a good chance the advice is either biased or wrong

    hi there

    just to update you as you were so helpful last night. My insurance company/DAS are going to chase the other driver to within an inch of his life to recover through his ins policy. failing that they will take him to court, and worst case is it will have to go through my ins policy. I have prot no claims so we will see what happens xxx police will prob prosecute him too for numerous offences. thank you so much for your help last night.

    They cannot normally recover the hire car costs from your Insurance unless you have a DAS policy that provides replacement vehicles at their cost which is relatively unusual, did you ask them to confirm (Ideally in writing) that you are not liable for the hire car costs.

    They will be charging about £60 a day and they costs soon mount up.

    What were people sending you personal messages about last night, it's against the ethos of MSE and the advice they may have given you may be wrong.

    yes i have a DAS policy that provides replacement vehicles and they have confirmed that the cost will be covered, but they still seem 100% positive that they will get a result through the op policy. time will only tell and i have spent so much time and energy on this. The op is a horrid individual who wouldnt know right from wrong if it hit him in the face.Not only did he give false details, drive off, lie, have previous convictions for fraud, harassment etc and been in prison he has now stopped paying his ins prem by dd!!! I have been so upset for a week now and its made me ill. I will get my car back and will see what the future brings. I tbh hope they throw the book at him. x
