A Small Victory

Sainsbury's in Huddersfield had signs saying parking in a disabled bay without a valid ticket will result in a £60 PARKING FINE from Euro Car Parks.

Not any more they don't, they now say PARKING CHARGE.

After informing Trading Standards of their attempted extortion some one as had to pay for new signs and it definitely wasn''t me, i don't think Sainsbury's would have paid for them either.

It took a while but it got there in the end so at least it cost Euro Car Parks some money, less to extort people with.

Little things like that could niggle them and i like the other thread about planning permission for cameras because that's next with another store in Huddersfield who have not got planning permission for their ANPR cameras after checking the council website.

Every little helps !

The signs could still need some work.

The Blue Badge scheme doesn’t apply to private car parks. Anyone, who’s disabled under the terms of The Equality Act 2010 can use a disabled parking bay. If they’re also Blue Badge holders, they don't need to display it.

The terms & conditions for private car parks usually state that you shouldn't park in a disabled bay without displaying a Blue Badge. This, therefore, contravenes The Equality Act.

Our local (small) Sainsbury's has the right idea on their disabled signs. They say "if you are registered disabled please feel free to use these bays. If you are not disabled, thank you for not parking here."

There is no mention of blue badges, the car-park is PPC free, and it seems to work OK.
What part of "A whop bop-a-lu a whop bam boo" don't you understand?

You know that Stephen, i know it and so do a lot of others but unfortunately trying to tell that to someone at WYTS is like banging your head against a brick wall.

The first fella i spoke to on the phone actually said to me that a PPC can fine you believe it or not !

I did eventually speak to someone else who was a bit more clued up. We all know the signs shouldn't be there but until some one with a bit of power takes them on it's down to us to grind them down a bit and get the word out, which i do.

People with internet access now like everyone who posts on here, should not be scared of a bit of paper coming through their door because, to some, it's scary because it mentions "debt collectors" or "credit rating" and other words along those lines.

There is information out there on the net for absolutely everything, all people have to do is a bit of research and educate themselves and they will be more informed than they ever were instead of sat watching soaps amongst other rubbish spewed out from that box in the corner of the room.

It is up to the individual to educate themselves or get fleeced, it really is that simple.

I'm beginning to sound like a cracked record, but you should write to the CEO of Sainsbury pointing out that they are responsible for the actions of their agent and that where an ECP sign breaks the law in a Sainsbury car park then so does Sainsbury. That should get his attention, particularly if the lawbreaking is in regard to disability rights. Cuddly family supermarkets do NOT like to be caught out over things like this, and a consultation with their legal department followed by a pretty fiery rocket up the backside of ECP is likely to result.

If you go to this old thread https://forums.moneysavingexpert.com/discussion/1966977, you'll see it has all been done before, so the head honchos at Sainsbury's certainly know the score.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

In my opinion good old fashioned snail mail carries a lot more weight.

There is nothing in that thread to suggest that anyone wrote to the CEO. Writing vaguely to "Dear Sirs" at the Head Office address is a waste of time as it guarantees that it will get dealt with in a perfunctory manner by a nobody in Customer Services, the CEO will certainly never get to hear about it.

how Would A Supermarket React To A Claim Against TheM For Harrasment By One Of TheirAgents?
    From the Plain Language Commission:

"The BPA has surely become one of the most socially dangerous organisations in the UK"

Or indeed for a compensation claim from a disabled person who had been discriminated against by one of their agents.
