Most mobiles have a record facility have it ready set him up wait until he says it then produce proof on mobile that really will change matters a lot more productive than writing down or getting another witness i would then let him hear it and threaten him (in private) you will take it much further and how will that make him look a saddo who whistles at other men.0

I see the big problem here is that the Op did not realise that blood is thicker than water. He relied on this guy's brother to help him with the problem rather than tackling it with the guy directly. Then the brother changed his tune when the OP dicided to make a compliant. Hardly surprising but understandable as the brother seems to genuine enough, but when it comes to risking getting one or both of them the sack, closing ranks is likely to be the only outcome.
Advice is to put it down to experience and leave it at that. Do not under any circumstances have any social contact with these guys. Ignore them other than what is necessery to do your job.
You need to develop more allies at work. You seem to be short of allies there.0
