ending 3 contract

phoned 3 to end contract . was told it would be ended in 28 days.{notice period}. however phone was not disconnected until 7 days after the 28 days had expired. after 28 days i left phone lying around beleiving it was of no use as it was disconnected. however when i received a bill i saw that it had not been disconnected until 7 days after . and as the kids had been playing with it call charges had incurred. i beleive i should not have to pay for these {the 7 days after} as it should have been disconnected.
have contacted 3 about this who say a technical hitch occured that is why disconnection did not take place at the correct date and are saying i will have to pay for the 7 days as well. they are being awkward about this .
customer services is unhelpful as they will not do anything about this.
any help advice appreciated

    If it had been switched off and unused you might have a case
  • the contract says that they provide a service & you will pay for it. if the contract has ended, you are no longer obliged to pay them.

    does your documentation definitely say that the contract ends 28 days after you give notice? do you have any proof of your notice date? if so, withhold payment & send a recorded delivery letter to their legal team stating the above & asking on what grounds they expect you to pay.

    3 cust. serv. continuously tell me of the date i gave notification and tell me that the contract did end on the correct day. its just that the phone was not disconnected from their end at the correct day. which should have been 28 days after i phoned. it continued for another 7 days before it was disconnected due to a technical hitch on their side.
    they say i have to pay for the usage for the extra 7 days which i am disputing as i had given notification and instructions which they had agreed to and informed me that it would be disconnected after 28 days..

    Hi don't suppose you transferred your PAC code from 3 which might have delayed the termination?
    I am in the final days of my 28 day notice of termination with 3 (thank goodness) and phoned them the other day to ask for the Pac code. 3 customer service said OK your contract wont end now until your new airtime supplier activates your Pac code. Not having another contract yet but being desperate to leave 3 I said no I just want the Pac code, communicating with the 3 operator wasn't easy as he had a very heavy foreign accent and proceeded to say"OK Sir that's in place" even though I kept saying no forget it, leave my termination date as is and forget about the Pac code. Not exactly sure where I stand right now and will have to phone 3 back again, hope that the next operator speaks better English.

    i never knew anything about pac code,
    i just use phone to make calls!!!!!!

    This is all fine. But you have told us that you used the phone. It is that usage that they wish to charge you for.

    If a bank wrongly pays money into my account, then ask for it back, any attempt by me to keep it is fraudulent

    As I said before, if your dispute was only line rental, you'd have had a case. I can't understand why you think that their delay in disconnecting the account entitles you to free phone calls.

    Another point. There is not a phone on 3 that has enough battery life to last 7 days. If the phone was used 7 days later, it can be assumed that you charged the battery. Why? Why are you attempting to blame your kids for this?

    Jeff the PAC is not the means of ending the contract; it is to transfer the number to a phone with a different provider, and so is activated by the new company's action. You could temporarily transfer to a payg SIM while you look around for a new contract.

    Thanks andy88, I had not thought of that and have an unused Tesco mobile sim card (pay as you go) that I can transfer the number on to.
