Ebay item - misleading description - refund?

Hi,
I basically would like a bit of advice on ebay and my rights as buyer.
I have bought an ipod from ebay - second hand of course. Buyer reg.. since May this year and only has had 2 feedback's before my purchase.....
It arrived today and doesn't even work. Seller described it as : "a couple of scratches. Nothing major" that was the total description. It has a damaged LCD screen and will not hold a charge when charged with AC adapter. Same thing happened to my existing ipod and turned out to be a dud battery.....
I paid £83 for this and have emailed ebay awaiting another reply as we speak.....
Also postage was listed as £4.80 when the recorded delivery postage was marked as £3.65 on the package - not "nit picking" but still a difference in price....
I searched for the seller contact info - phoned the mobile number listed with ebay and of course it is disconnected.
The address is listed as Blackpool, Lancashire, United Kingdom.
So even if I want to send the ipod back (which I do) I have no postal address to send it to!
It appears this guy has registered with ebay in May sold 3 items (this ipod being one of those) and now I cannot get hold of him.
The money has already been charged to my credit card. I used Paypal for the purchase (always would)....
I am worried and wondering my rights as regards this transaction and if ebay/paypal are insured/covered against this sort of thing.
What are my chances of getting the money refunded?
If someone could shed some light on this I'd really appreciate it...

Open a SNAD case in paypal and they will give you the seller's address to return it to. You will need to send it special delivery at your own expense in order to get it tracked and insured properly. Upload the tracking information and once it shows as delivered you will be refunded.
I think you can also report the seller to ebay for not having the correct phone number listed.
You don't mention in your post, but I'm assuming you've already messaged the seller as well to try to resolve it this way first?0 -

This is the sellers address as listed on ebay:
Blackpool, Lancashire, UK...? Is this a bit lapse on ebays part? I mean he is registered with them to sell without even a full postal address - how is this possible?
Anyway - I have opened a SNAD case and I have tried contacting the seller b(would have preferred to sort it that way first) emailed him twice today - and a phone call as I mentioned to his listed mobile no - which is disconnected it seems. Sound suspicious?
That address bit is really puzzling me - so I dont have any address to send it back to....this seems very strange....

The sellers full address wont be visible on ebay as that could create all sorts of problems - flip this around would you be happy to have your full postal address broadcast to anyone/everyone looking/bidding/purchasing your items?
When you escalate the dispute and you are asked to return the item for a full refund ebay/paypal will provide you with the full shipment address to return the faulty item.
For future reference, all sellers must provide a full postal address before they can sell/buy on ebay - this is hidden from buyers until such time that it is needed and is provided (only the area of residence is shown in listings)

Sorry, but you do appear to be nit picking, especially as the charge quoted on ebay is for postage and packaging.
According to ebay policies, the P&P charges must be specified (which it was) It's only against ebay policy to "provide unclear or misleading delivery information or to charge unreasonable fees for postage and related services."
It'll cost you a lot more when you send it back Special Delivery0 -
It is very simple; you paid using a debit card via Paypal, this "insures" you for things like this. I have (in the last two weeks) had to refer to the complaints as one item failed to arrive, seller has disappeared so eBay refunded the money, yes you have to wait a while as the seller may be away/ill etc but I have always found eBay to be fair regarding protecting your rights.
Just as an aside, NEVER return anything until you have contacted the seller and always use the dispute procedure as this protects you further, anything sent back MUST be recorded/registered or you might find you arent covered by eBay.Saving 1 animal wont change the world - but it will change the world for that 1 animal

I have already done a search for their postal address which I thought is only visible to myself because I have already purchased the item and am now in dispute over it.
Obviously I know the address cant be visible to everyone as that would be crazy and as you say create all sorts of problems/.
I thought as I had already purchased the item - I can ask for their contact info/address and ebay have told me mine is visible to them and they are notified I have asked for the info...
So what I am provided with in this case is only "part" of the full address?...so you mean ebay have on file extra info not made visible to myself?
Its down as the sellers registered "registered address" - which is what I was supplied with so far....
I have spoken to ebay and they have told me that the seller is responsible for "updating" their address in this case - which would imply that is all ebay have on them - ie what they registered with....
Maybe there is more to this...?

Thanks for the info...
They have just told me this morning that the seller has until 11th August (i.e, 8 days as I made the complaint on 3rd Aug) to comply and get in touch.
As I stated further down - they are also responsible for updating their address - if they dont they are in breach of the ebay rules and will lose their case.
From searching the net it seems ebay seems to side on the part of the buyer in most cases anyway (as there are a lot of disgruntled sellers I have found ::0) who have been "ripped off" by people claiming 100% goods were faulty or did not match description - yet the buyer always won the case leaving the seller out of pocket everytime...these are obviously genuine sellers I am talk about....
In 10+ years of using ebay This has never ever happened to me, hence why I dont know the procedure...good to know that I am covered for this. Suppose there is always a first time.....
And yes - as you say I will do everything "by the book" in order to have this refunded - cant do much anyway without the right address for returns....dont really want to be left with the thing anyway as its pretty useless without a new LCD screen and a new battery....

So in other words when the postage is quoted once you purchase you have accepted that and thats it?
I know some sellers do "rip the *** out of it" with postage but I suppose you have the choice to purchase or not...

You chose that seller with that postage, Why not look for one with free postage? It probably wont be any cheaper in the end.
The seller still have to pay postage charges and packaging needs to come from somewhere.Censorship Reigns Supreme in Troll City...0
