Buyer claimed damaged then fake

Thank you - I will just reply saying it is genuine but if they have suspicions to return and I will refund once received.
This really isn't worth it - the bag was sold in aid of charity and it really takes the "point away". I'd rather just donate as a raffle/tombola prize without this hassle.0 -
Did you list the name of the maker in the ebay ad? if you did you can't now say that it is just a bog standard bag, if you didn't list the name then I would think it would be hard for them to claim it's a fake if you didn't sell it stating it was a certain makers bag.0

Erm of course I said it was Radley.
By bog standard I mean not a huge designer (ie not a Dior or Marc Jacobs, Fendi et that are ususally faked and you buy in Turkey etc)
This was a plain black work bag - not a picture bag, not a Radley Ltd Editition.
They were unhappy from the start. They emailed to say they were disapointed that it was sent Special Delivery as their sorting office is miles away (checked and they had already signed that day and so were in), then it was damaged (no proof provided), now it is fake.0 -

That violin thing shouldn't have happened, or if it did, then there is more to the story than that.
Normally Paypal only refund on evidence from Trading Standards that the item has been destroyed by them as a fake, not on stuff like that. The seller might have made an error in the procedure. We only have their side of the story.
If the buyer has opened a case through eBay, the seller has to prove authenticity or arrange for a return. Paypal will make sure a fake item is destroyed, but in this country (IIRC that was a Canadian purchaser/seller) the purchaser must acquire proof from TS; it takes a while and it's a faff so it's something that the buyer has to do before opening a dispute because the dispute procedure would time out before TS gets back to them."Well, it's election year, Bill, we'd rather people didn't exercise common sense..." - Jed Bartlet, The West Wing, season 4

If you have the buyer's original email to say it was damaged (and this was sent through ebay) then you might have some evidence to present to Ebay that they are trying it on?
Furthermore, they will have evidence from Ebay that the buyer hasn't tried to contact you, and that you have tried to resolve the dispute the correct way.
Of course if you haven't communicated through ebay, you might be a bit shafted on this but if you have, then I think you could present all the evidence and your own reasonableness and make a good case for yourself. Whether ebay take notice I have no idea - would leave that up to the more experienced here to advise.
Just wondering what would have happened if you replied "thought it was damaged not fake, I'm still awaiting those pictures, by the way."
Sounds to me like she'll probably send it back though because she's looking for any excuse just to get her cash back. Just try to make sure she doesn't shaft you for the postage."So long and thanks for all the fish" :hello:0 -
It doesn't sound like paypal or ebay destroy them - How do they know they are not swanning around with the genuine articles and said they destroyed them. Seems to me it's an easy way of getting goods for free.
I will scan a receipt for a similar bag that I have found in email as bought on line and present that and other quotes above ask them to review the messages via My Ebay and then what will be, will be.
The hurtful thing is that this was a charity sale - it isn't me they are hurting.0 -
Paypal need proof from Trading Standards to say the item is fake before they will refund without proof of return.
If you try to con eBay yourself with a 'similar' receipt you're no better than they are. Mindless Clone has a better idea - contest the dispute vigorously and give eBay the emails, assuming you've kept them."Well, it's election year, Bill, we'd rather people didn't exercise common sense..." - Jed Bartlet, The West Wing, season 4

Although that's not to say you can't email the buyer to say "I've found a receipt for the item as proof of my purchase of it from a reputable retailer and will be submitting to ebay as proof it is genuine" and then see what they do?

Make sure once you have received your bag and issued a refund that you block the buyer from bidding on/buying any future items you list.
The help section on ebay will explain the process to do this - you just need their ebay username.
Unfortunately there are a minority on ebay who scam and try to get things for free. My first learning curve was not sending a mobile phone recorded (yes I was young and stupid) and of course the buyer claimed the item was never received. £70 lost. I send everything recorded now.
I also sold a Karen Millen corset and the buyer had a Karen Millen online shop. I listed loads of photos then once she received the item she opened a dispute to say the corset was old and stained. Ebay looked at the photos I had taken and agreed it was immaculate. I barred that buyer from every bidding on my items again.
good luck and hope it works out your way. Insist that if they want a refund they must sent the item back to you special.recorded delivery.0
