H&M always run small, surely everyone knows that.

Not always, they often run big. I have 2 not dissimilar jumpers from H&M both of which are supposedly size 16. One is enormous and nearer to a size 18, the other equivalent to a size 14.

As there isn't a H&M in every town like there is a Next or a New Look for example I think its perfectly feasible that not 'everyone knows that' don't you?

even if you could return them the seller will not refund the return postage and I would think it fair to take the first postage cost off too so you are really looking at a very small refund, bit unfair of you to admit the item is only cheap but still expect a level of customer service you would get from a shop, it's ebay and a cheap item not M&S.

Is it only me that thinks the seller should have added this to the description? Its obvious that not everyone is going to know what H&M sizing is like and if its that bad then surely you have no way of knowing what size the jeans would be (if not the size on the label). Ive seen a fair few listings mentioning label size but they think it would actually fit a size # and even giving the statistics so you can compare.

Sellers that risk not providing accurate descriptions risk negative feedback and their stars getting trashed. The seller had obviously tried them on and therefore must have known the size wasn't accurate. I also though would never buy a brand I wasn't familiar with as I know what size I am in different stores. I have never been in H&M so wouldn't know what their sizing is like although by the sound of it it is inconsistent.

No, I do too. But I accept that when you're buying of a member of the public (not a shop) they can make mistakes.

If it had been me being the seller, I would have invited the buyer to return them I think, and taken the hit on the postage and learnt the lesson for next time.

The problem with eBay is it is getting much more professionalised by the moment. Clothing really is something that doesn't work well in online shopping. But if you sell clothes, then you should be prepared for what can go wrong, which is an awful lot more than with books, say. I've offered change of mind returns for quite a long time but I've only ever refunded twice - once when an item arrived completely DOA and once when I made a mistake on a listing - the buyer was happy to accept the item but I made a partial refund to reflect the wrong information given in the listing that I had lost the instructions that were supposedly included.

A few minutes to sit down and think before starting to list clothes should really be taken - particularly about how people buy clothes and definitely about any issues with sizing as seen above.

She hasn't mis advertised them she is stating they are a size 18 and they are. It isn't her fault H&M sizing is small. She might be a size 18 and they fitted her so she wouldn't think to mention it in the listing and it only came to light when you told her you could not fit in them but your sister could.

I seriously hope ebay dont grant a refund in your favour as they already favour buyers over sellers.

It might have been thoughful of her to provide measurements though, which she didn't do.

eBay do favour buyer over seller, as do most other sites and consumer law, otherwise ecommerce wouldn't work, we'd be at the complete mercy of people like the iPad scammers.

This is one of the few gaps, but if sellers want to sell successfully, they still have to think about what they sell and how they sell carefully, otherwise they just get disappointed buyers - and that is dangerous in itself.

    .

But then again, surely its up to the buyer to ASK for measurements especially in clothing.
