refused refund for jeans

i bought a pair of jeans off ebay. they were stated as been a size 18 and the label on the tag does say 18 but these are clearly not a size 18 (they fit my sister perfectly and she is a size 12/14) so i messaged her and asked for a refund but she is saying as she stated no returns that i cannot return them for a refund.
"Hi - I am sorry but my advert clearly says no returns. The jeans are marked as a size 18 on the H&M ticket and inside. It is not my fault that H & M are smaller fitting. I have clearly and accurately described the jeans and stated my retuns policy."
this is what she said. but she did not put in the listing that these were smaller fittings.

The first picture is the original advert one - however I have also included another one as I think they look slightly different from the original. The crease pattern is very pronounced in the original picture - and I don't think it's as noticeable in the jeans. Having said that - they are lovely jeans and I was very happy with the purchase and quality - they are just too long.

The easiest way forward is to sell them to your sister or sell them on.
No one can ever be sure of the fittings from one shop to another re sizing so I dont think you can do anything.
Having said that the seller says 'they are too long' surely if she liked the jeans that much she could have just taken them up lol.

Can you compare them to other H&M size 18 jeans? If they are wrongly labelled open a SNAD, if it's just because you didn't know the way H&M sizing works, then sell them on.0

i paid £10 for them, its not a great deal i know but i still want it back as they are not an 18. and i cant compare as i dont normally shop there. thanks for your replies0

H&M sizes can vary a lot and some tend to be wildly off - e.g. I have a size 14 pair of shorts and a size 8 pair of shorts from there that both fit fine. It's just a shop where you definitely HAVE to try things on to be sure. Your best bet may be to sell them on yourself, as although she didn't state that she felt they were smaller than labeled she hasn't lied about the size (for example, she hasn't said they're a size 18 and they've arrived with a size 12 label).
People can be wary of saying "tag says size 18 but fits more like a 14" as if a size 14 person buys them and they don't fit they will complain because they've been told they should fit.0 -

They ARE an 18 - they say it on them.
Thats said - if i sell anything i know to not be a normal fitting - i clearly state it. As the seller admits to trying them on - then i believe she knew this - and should have stated.
If i buy items that don't fit - i just sell them on. But that said, if i sell anything - i always accept it back too.

If you buy from a private seller you must be prepared to keep items if they don't fit or you don't like them. If you want the ability to try things on and return any that don't fit then use a business seller.

Yes, last time I went into H&M, as a size 12-14 I was embarrassed that I couldn't struggle into size 16 trousers. Definitely not somewhere to go if you feel anxious about your weight.
If you already sell then you could give it a go. While I would never insist on anyone getting themselves into selling simply to sell something on (it's always suggested but there are a lot of logistics and responsibilities involved and perhaps frustrations if you can't get your money back when you do sell something - which to a non-regular seller might tempt them to decline the sale), and would always allow change-of-mind returns on clothing (and would usually advise sellers to accept stuff back, because it makes for a more pleasant experience for everyone), that seems the most sensible solution here."Well, it's election year, Bill, we'd rather people didn't exercise common sense..." - Jed Bartlet, The West Wing, season 4

I've bought stuff on ebay before that's been creatively sized, so to speak. It's frustrating but I do accept that sizes to vary (and, usually the seller states what it actually fits). If it's new and from a retailer, I will return but usually not from individuals as I know they're usually selling in good faith.
