    I spotted that bit about NO Equalities implications as well. :eek:

    I guess they are thinking that the Blue Badge scheme lawfully applies and they know what they are doing 'cos it's all the same rules and law as decrim parking...we won't tell them yet then!

    Which confirms the 1% figure quoted in that London Councils Document.

    I like the idea of costing PPCs £32 for every appeal, that should eat into their profits quickly.

    Apologies if this is a random question.

    Will PPCs be able to keep their own internal appeals process after 1 Oct? If so, will they just carry on as per now?

    As far as I can see the so-called IAS will only be available to members of the British Parking Association's Approved Operator Scheme and there is nothing to stop them retaining their internal appeals process as a first step.

    Bearing in mind that the IAS was the price for RK responsibility I fail to see anything that will stop PPC's that are not members of the AOS, nor even the BPA, from stating on the invoices that the Protection of Freedoms Act creates that responsibility. They will surely argue that it is merely a statement of truth.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    The bit I read suggested that the 'independent appeals procedure' will only be available if the motorist has exhausted the PPC's 'appeals process'.

    So in order to waste their money, the advice will change to appeal once, appeal twice, then ignore?

    A nice idea would be to get it proven (so that everybody knows)that no ppc can charge unless they own/have ownership rights to a car park then they would have wasted all those thousands signing up.
    I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

    Read the document but still unclear one at least one point. It state that the PPC must exhaust its own process nefor an appeal can be launched. Does that really mean that drivers will still face all the same harassment from debt collectors and solicitors before an appeal can be launched. Under traffic act you can appeal immediately. Who the hell dreamt this up

    One advantage may be any appeals that may be allowable that would have been straight refusals previously may be allowed now before it costs the PPC.

    For any appeal to the IAS the first point would be to ask under what authority do the PPC claim, do they own or lease the land?

    It goes back to the point many of use made when this bill was introduced, it makes the RK liable but does not make it clear what the liability is.

    I would imagine some of the more litigious companies will issue claims if they have to pay the IAS, and then are ignored.

    Fun times ahead!:D

    I've never seen anything in a ppc's terms and conditions which limits the number of appeals you can make. You could make dozens then go to IAS. How many times are you allowed to appeal to IAS?
