Can a (council) parky give you a ticket if he's off duty?

    I honestly dont know, my OH brings her work laptop home with her, a mate of mine who is a plumber carries all his tools around in his van..

    Before the council here went on to 24hr rotas for parking enforcement, they hired-in patrollers from another council for about a month to test the idea and I noticed that none of them operated in uniform.

    It's still potentially fightable. Even if she was, strictly speaking, in the wrong, there are 101 errors that the council and the CEO could have made, rendering the ticket unenforceable. You will need to scan it (both sides) and post it to the forum, so those with more expertise can pore over it and pick holes in it, giving grounds for appeal.

    It's always worth appealing in the first instance. You don't lose anything, and it may succeed.

    Without having seen the ticket I think there are grounds for appeal.

    Just had a look on streetmaps and one end of the lines doesnt have a T bar on the end, I cant see the other end as there is a car parked on it (with no ticket on)

    Its ME10 3RE if anyone wants to look on streetview, right opposite the door of the co-op around where the black corsa is parked.

    The end with no T bar is around a corner though, not sure if that will make any difference? Once the OH gets home with said ticket I will post it up on pepipoo with screenshots of streetview..

    OK seen ticket now, it has the wrong road name on it, need to go and look at the lines tomorrow.

    Thats good to hear, also just uploaded a pic of the envelope containing the PCN, its just a load of squiggles as the CEO was "writing" it in a hurry as he saw the OH coming...

    Send an appeal.

    You were parked in Church Road which can be verified by the council's own photos and therefore the contraventon, as alleged on the PCN, did not occur.

    Believe it or not this does actually happen. Some CEOs can be on a late shift and then start early the next day so they take the gear home with them until they're next in the base to download their PCNs to the main system.

    Likewise, some clock on earlier than the others and get in early to get their gear. I've had to do this one myself when we had complaints of a car in the mornings being where it shouldn't be - I had to come in an hour early and deal with 'her' who didn't think the rules applied to her. She had the shock of a lifetime when I served a PCN on her "before the wardens are on duty" :D

    I never took my gear home but I've known cases where it has happened and its not uncommon. Oh and yes parking staff do frequently use their own cars to get to certain areas - I've done so myself (along with colleagues), we just learn where to hide them out of sight :o

    Going to write the appeal letter shortly, had it confirmed that the road name changes in the middle of the bridge so well before where the alleged contravention took place.
