Can a (council) parky give you a ticket if he's off duty?

OH got a ticket this morning for parking on a double yellow while nipping into a shop on her way to work, when she come out of the shop there was a ticket on the car and the parky was getting into his car and driving off, she said she didnt think he was on duty..

Havent seen the ticket or anything yet as shes at work so will have a look at it later but just wondered if they can give tickets while not on duty?

    A, I dont know, just going on what the OH said in her text.

    B, Presumably the council would have some kind of clocking in/out or at least a rota for the parky?

    Or, of course, the OH could just refrain from parking on double yellow lines. Then the employment status of the attendant would be irrelevant. Why do people seem to think that the rules do not apply to them.
    I can afford anything that I want.

    The question is, was he in uniform or not. In and it counts but is still fightable, out and it does not count. However you have to prove he is out, the time slips are a good start.

    Turns out he was in uniform, not sure why she thinks he was off duty, probably the time, she said he was just getting into his (own) car as she come out of the shop like he had also stopped on his way to work..

    Will have to look at the ticket later..

    It's still potentially fightable. Even if she was, strictly speaking, in the wrong, there are 101 errors that the council and the CEO could have made, rendering the ticket unenforceable. You will need to scan it (both sides) and post it to the forum, so those with more expertise can pore over it and pick holes in it, giving grounds for appeal.

    It's always worth appealing in the first instance. You don't lose anything, and it may succeed.

    If he had his ticketeting equipment with him of course he was on duty. Or did you think traffic wardens took their machines and tickets home with them every night, gave them tea and toast, read them a story and tucked them up in bed ?
