They said if I sent the shoes to them they would look in to it but I'd have to pay the postage costs to send them to them. I'm not taking the chance as if they say no too I'll have to cough up again to get my shoes back (theres still a bit of wear left in them yet).
Have a look at the sale of goods act - the phrase that you mentioned 'fit for purpose' has some sort of legal binding (I don't know much about it, but DH is clued up) Ages ago - last Feb someone gave me a link to a page on the 'sale of goods act' and there is something in there that if you quote, they should take them back.
Keep calm and think it through, but I think you definitely have a leg to stand on!0 -

I've just tried to return these shoes to Clarks and I've basically been told to get stuffed. The best they were willing to offer me was a 50% refund.....on a gift card, which is no use to me as I never want another pair of Clarks shoes again!
Despite them only being two months old they aren't fit for purpose (which is what I told her) and that where the ball of my foot is shouldn't be worn through. One shoe is letting water in!
I ended up raising my voice and the manager said "don't shout at me or I'll have Martin here remove you from the shop" Poor Martin looked terrified when he turned around and saw me.
After a bit more discussion she offered me head offices number to take it up with them. I asked if she would replace them and it was a flat no. She said they had been heavily warn and abused. I don't bloomin go anywhere to wear them out! I pointed out that I'm a big chap and that's how the insides are sunken but nonetheless a £45 pair of shoes shouldn't be wearing through the soles in 6 weeks! I raised my voice again and she went to get Martin to throw me out. I then said "Leave blood y Martin out of this, he might be 6ft but he's all of 5 stone wet through, he isn't going to get me out of this shop, but I'll warn you now, I'm autistic and I DO NOT like being touched so if he so much as lays one finger on me I'll break his arms." Poor Martin stepped back in horror.
Where do I really stand with this? I'm pretty sure I'm entitled to a full refund or at the very least, a replacement pair?
your story did make me laugh though - poor Martin thinking he may have to tackle you!! :eek:chandlerscroft wrote: »Is that right Sainsbobs have the Finish dishwasher tablets for £9 and Mr T is £20.42 plus a petrol voucher.
Here were my workings out, nothing as good as the Heinz Mayo jtd though.

Post something on Clarks Facebook page and see what they say.
Always better to write a polite letter to HQ - address might be on their website, stating where and when the item was bought, enclose receipt or a copy of the receipt - very important to keep these in a safe place. State why you dont think the item was not fit for the purpose it was intended. Also state what you would like to happen - eg replacement or refund.
My sons biking helmet had a problem recently and he did exactly this - emailed the company first to let them know he had a problem and he would be writing to them and sending the helmet back. He had the receipt, said what the problem was and asked for a replacement. They replied quite quickly and sent him a replacement but the next grade of helmet up, no extra to pay.
I also had a problem with Marks jeans that developed a mysterious hole in the thigh. I sent the jeans back - you could see the wear was minimal, no frays at the hems or rubbing on the seams etc. They sent me a gift voucher.
Going into a store and shouting the odds, demanding things the staff dont have the authority to do, loosing your temper and swearing - these will never get you anywhere ...“Create all the happiness you are able to create; remove all the misery you are able to remove. Every day will allow you, --will invite you to add something to the pleasure of others, --or to diminish something of their pains.”0 -
LOL, just found my debit card that I lost last night. Oh well.0

I don't know it very well myself and that's where the problem lies, hence why she was just fobbing me off.0
