Is this near the Red Lion by any chance?
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

Just to reply to an above post regarding 48 hours, that's 48 hours to have the fine at £75, then it rises to £100 and then £125 the longer you leave it. Based on what you are saying, I will leave this and ignore it.

Can I ask a question: what could the owner of private land where all and sundry park do to stop inappropriate parking, if they wanted to? Just out of interest....because I can see of course they want to retain space for the tenants' cars naturally

No it's not near that Pub (that burnt down?) No, this is next to the parade of shops on Water Lane

OP, so you parked and didn't use any of the shops at the time. Hardly the crime of the century.

All the landowner can claim as damages for your action is what they actually lost as a result. If there was still a free space during your stay, then that is £0.00. And even if you did use the last space, they can't claim "speculative damages". The landowner may not even be any of the shops.

@ OP the point is regardless of the fact that you may have been unwise to have parked as you did that does not give free reign to Shoal Enforcement to claim you owe them £75. They are relying on your sense of shame to pay them when at law you owe them nothing. Do you have any photos of the signs. That would kill it.

I mentioned the Red Lion as there have been issues over misuse of car parks at the rear for many years. Its just the place where Shoal would want to play.

    Build lockable gates and fences.

A good question. I have every sympathy for a store owner, who pays good money to provide parking for his customers, and sees it being used by others. But, legally, there is very little they can do.

Using a PPC isn't the answer.

The only system that works is a barrier and ticket system. You get a ticket as you go in, get it validated in the store, and use it to open the exit barrier. But, from your description, I doubt that this would be cost-effective on this site.

PS. If it's for a limited number of authorised users, then a lockable barrier might work. But they're still not 100% (people don't lock them back up) and notoriously expensive to maintain (corroded locks, vandals with superglue, missing padlocks and lost keys, etc.).

Then your conscience can be clear about the parking. Your waistline is beyond our remit. :)

its not a fine, the correct term is speculative invoice.
private companys, and individuals can not levy fines.
