    my problem is the car and getting it back as i just said have spent nearly 300 quid to get it through mot and bought tax yesterday .

    but stupid enough for you son to drive it, if the residents area is not at all 100% private i.e locked off to public then it is classed as a public area and the rules apply the same as if he was to drive it to the shops and back. no insurance, car towed, simple.

    the matter here is that the insurers declined to honour the policy to enable you to get the vehicle released.

    the ombudsman will not involve themself yet your jumping the gun.

    you have to follow the complaints proceedure and give it 6-8 weeks and a final statement from the insurers to basically say your in a deadlock as to who is right and who is wrong and the ombudsman should pass judgemnt on the case.

    you say you son drove it round in the car park, if the car park has access for the general public to gain entry private or not it is in a public place and the law applies, same if the DVLA came and towed it its open to the general public and they could take it if it werent sorn insured taxed.

    like i said round the car park not on the road he had gone in house when he was told police were by his car :(

    i do not know why i bothered even asking for advice on here
    people just want to b nasty about spelling and commas :eek:
