police impounded sons car

my son got his car impounded for no insurance or tax he had just got it motd .
he took it for a spin round car park to see if the rattle was still there after putting tie on wheel mud flap.
anyway he was going to tax it and insure it monday .
his girlfriend changing her car insurance that is for both of them from her car to his
but saturday the police took it son was not in the car when police got to the car he was back in the house but came out after seeing police by his car .
on monday his girlfriend insured the car sons car from 11am her car till midnight last night .
then she was gonna scrap hers.
yesterday taxed it with insurance document went to police station with insurance doc, tax, log book,
they spoke to his girlfriend and phoned insurance company dont know what the police woman said but they cancelled her insurance saying she hadnt told them car was impounded.
but she had so now she is stuck 8 miles from home with no insurance thanks to the police .
when she got home rang the insurance who listened to the tape of her ringing up to insure and they said she did say car was impounded but should never of insured it . ?
is this catch 22 and my son will never get his car out and now she has no insurance any ideas folks please ?

    yes i know he was stupid
    we took for mot on tow truck bob as it was a 15 mile journey not risking that

    Well it sounds like the police acted properly and your son and gf have been caught doing several things that are illegal and may well end up costing them a great deal of money plus possible police charges.

    The car is building up costs while impounded so you need to find someone with the correct insurance to collect the car from the police and store it somewhere while this mess is sorted out.

    As other posters have said, this is going to be very very expensive. The driving without insurance charge and the cancelled insurance will almost certainly mean eye wateringly high insurance quotes in future, maybe too high to be affordable if your son and gf have limited budgets.

    One thing to consider is whether the car is worth recovering. This sounds odd but seriously, if we a talking a nice car, then don't read the rest of this paragraph but if we are talking a car worth a few hundred pounds formally signing it over to be scrapped might well be an option.

  • My suggestion talking from experience would be leave the cheap car there. Teach him a lesson - I know its hard, its called tough love.
    As for sons GF I would challenge the insurance in a nice way about what has happened.
    A - She declared where the vehicle was.
    B. It should not matter where the vehicle is at the start or change of a policy as it needs insuring to be removed anyway.(as long there is no chance of a claim to arise - ie its in the sea!! or something daft)
    C. The police should have no impact on how the insurance is dealt as long as it gets insured.(obvious thing here is to identify the vehicle was NOT insured at the time observed by them)
    I think the error here is 6 of one and half a dozen of another, but I would push against the insurance agent on the phone not fully fluid with how it all works - and they never ask for help from a supervisor or team leader. Problem here is they always push back to policy holder its their fault. Clearly here you have already established what was said on the phone. Key buzz words here have the insurance cancelled or withdrawn the offer of insurance?
    There is a definition of difference, if worst comes to worst get them to admit the withdrawn.

    Yeah, that's right, she's stuck and its the fault of the police.

    The only "correct insurance" would be a policy specifically for the impounded vehicle.

    Policies nowadays contain the following:-
    Excluding use to secure the release of a motor vehicle, other than the vehicle identified above by its registration mark, which has been seized by, or on behalf of, any government or public authority

    Thank you for clarifying that.

    I knew there was something needed to collect an impounded car over and above normal 'drive any car' type insurance but I wasn't sure what.

    I'm really unclear from the OP what the current status is though apart from neither son nor gf nor car currently being insured. OP is the car taxed and MOT'd?
