Advice needed on Private Car Park fine

Sorry, but that is utter rubbish. Pretty much all of it.
So pretty much all of what I said is rubbish.I'll answer it later, I'm in a meeting now. Not ALL of it is rubbish, just most of the Council Civil Trespass bit.
Now not all of it is rubbish afterall.
I'm not going to hang around here arguing about this I have better things to do. If you know PPCs inside out and have tons of experience in the parking sector then fine, you go about your business the way you want. I quit the industry a long time ago as I got fed up with their arrogant ways and I really can't be bothered to argue about it when you're going to turn to things like wikipedia to prove a point.0 -
Since when did 'tons of experience in the parking sector' be the necessary requirement to either understand or debate the finer points of trespass law?
I've given you actual examples of where PPCs have attempted to operate in the trespass space where you've previously stated that they don't, and you've conveniently ignored it. Are you not going to address this at all?
You're simply banging on about whether I accused all or some of your earlier post being tripe, instead of discussing the content and issues.
Oh well, your choice, and to be honest I am also growing tired of this seemingly one-sided debate.
Lets just leave it at me stating that PPCs do operate within the Trespass area of the law, sometimes where they don't even realise it, and probably sometimes when they do, and you saying they don't ever.Je Suis Cecil.0 -
Hi All,
back to the topic of the original queries in this thread, it has been some time now since I started ignoring the letters for the car park fine (1st one was received aroun September 2012).
After ignoring around 3 reminders, I recently have recieved a letter from Roxburghe Debt Collectors.
As you have all told me to expect these kind of letters, I am still planning to ignore their letter to "resolve the outstanding PARKING CHARGE NOTICE".
I do have a couple of bits from the letter which worry me a little though, so your comments on these would be very much appreciated :
a) "If we do not hear from you within 14 days we will pass the matter to our solicitors, Graham White" - Should I be worried about this threat ?
b) "We are fully aware of anecdotal information being presented via the internet and on various websites adn you may well feel this guidance is worth following. We strongly urge you to seek independent legal advice rather than rely on those opinions" - Do you think this is new and could things have changed where it would be a risk to keep on ignoring these letters ?
Many thanks in advance for your help and for your brilliant and selfless opinions in the past.0 -
Graham White is a trading name of a real solicitor called Michael Sobell. He allows Roxburghe to use this trading name to issue more threatening letters (of which we have seen umpty ump squillion on here). So the letter from Graham White is sent by Roxburghe's.
As for the second point, consider this. They make money if you pay up. We make no money whatsoever if you don't.
So consider the vested financial interests at play and ask yourself who you think is correct here?!
Clue: It's us!Je Suis Cecil.0 -
Thanks ManxRed,
I agree that there is no gain from providing incorrect info on the forums, my main concern when asking about point 2 is whether you think these collectors have changed any tactics or if there has been a change in processes that would make my ignoring of the fine a potential risk ?
From the first bits of your response, I gather that there are loads of people out there who are sucessfully ignoring the letters from Roxburge and Graham White though.0 -
They can change tactics or processes as much as they like.
Its the law they need to change. That, sadly for them, isn't in their favour. The tickets are still unenforceable. Contract Law hasn't changed significantly for hundreds of years.Je Suis Cecil.0 -
Google the 'anecdotal' phrase...:)PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi All,
After ignoring around 3 reminders, I recently have recieved a letter from Roxburghe Debt Collectors.
Has it not sunk in yet?
The only reason they have not taken you to court yet (despite threatening it a few times) is because they have no case.
You owe them nothing!
Debt collectors have no more powers than you or I. They cannot enter your property without you agreeing to let them in. All you need to do if they ever contact you is to tell them to go away. The word "gullible" isn't in the dictionaryTickets: 19 [cancelled: 18, paid: 0, pending: 1]
