he could still mate a late appeal based on misinformation provided at time of seeking advice from them, they will investigate the misinformation and if it seems he was told he had no base to appeal the decision to hear the appeal will be a positive one.
Oh he can still appeal then?
What happens, as it is very common from my experience, that they deny that the telephone call was received or what was actually said?
The many times that I have telephoned and even sent letters in to the DWP, there is never any record on their part. They just simply deny the event.
My general opening comments on a telephone call are - "I am referring to my telephone call /letter dated *****.Could you tell me what is happening? We have no record on our screen of that call/letter - what was it about?" Then I start from scratch again. then I am told " I have sent an email to the relevant department who will ring you back within 10 working days" The telephone call or reply is never received. Then I start again after waiting three weeks. This goes on for months!!! I had to wait 12 weeks before they decided to put my ESA back into payment after submitting an appeal.
The best one is the Pension Service - they even refuse to contact anybody when you ring up if you have other money coming in - they tell me "we are only allowed to contact that department if you have no money at all coming in, otherwise you have to wait for a reply".0
