transfered from Icap benefit to ESA and now saying i cant have any money

I have been on Incap benefit for years due to having various problems, and even my specialist says I cant work I get DLA higher rate mobility (i have a disability car) in March i got a letter saying i was been transferred from Incap to ESA i sent of the form what they first lost, so I got a second and sent it back recorded, nothing happened to June when I got a letter to go for a medical what I attended.

three weeks later I get a letter saying I wont be getting any money since my Boy friend works to many hours and would have to work under 24hr a week, I'm now without any money for myself and have debts to pay, and me and my boyfriend are totally skint we are not sure how to make ends meet, can I appeal this or is that it?

Im not sure what to do now any advice would be welcome

    I'm rather confused as they are saying you aren't entitled to income based which is correct. However as you were on IB then you would be entitled to contribution based for at least a year. What was the result of the medical itself.

  • they said because I have been on Incap for so many years I wasn't entitled to the contribution based, the result of the medical was that I could'nt work due to my health problems

    the way its going I'm going to have to take up grooming again just get some money and keep the pain killers topped up and grin and bare it as we really cant live with no money I have debts and my partners money all goes on bills and food

    i assume the OP didnt pass the medical, in which case they can appeal within 1 month

    I think the OP hasnt passed the medical can appeal but will not be able to get the appeal rate as its Income Based as the boyfriend works over 24 hours......

    does your boyfriend work more than 30 hours?
    if so wtc may ne an option
  • I will ring and ask for the report but cant see how I would have failed when I passed my DLA medial in Feb and have specialist and doctor reports saying I cant work, its really annoying as I cant relay on my Boyfriends money as its unfair and I have no independce

    Were not entitled to WTC he works 35hours

    Did it state which group you had been put into (Work Related Activity/ Support)?

    then that means his income is too high.

    you need to talk to your creditors and try to make a mutually agreed payment plan to pay your sebts.

    That's not right at all. It doesn't matter how long you've been on IB you can get contribution based ESA.
