transfered from Icap benefit to ESA and now saying i cant have any money

This information from Disability Rights should help you:If you are migrated onto ESA, after April 2012, are placed in the work related activity group and are only entitled to Contributory ESA when you migrate, you will be paid ESA for a year and then this will cease. If you are migrated before April 2012 you will receive Contributory ESA for a period of 12 months less any time that you were on ESA before April 2012.
Of course, this only applies if you passed the WCA.0 -
Could the OP have been on IS due to incapacity rather than actual IB. Would that make a difference regards income or contribution based ESA?0

Unless the boyfriend only moved in after the WCA, the OP would not have been on IS.
If someone is on IS they will be transferred to IB ESA.0 -
Hi I have rang ESA today and apparently I didn't have enough National insurance contributions so I rang the NIC helpline and I have 49 credits what makes me £37 short for a full years worth of ESA, I'm now waiting for ESA to ring me back to sort it out

If you have been on IB you have transitional protection, your NI Conts should not be an issue now. Has there been any break in your claim, have you returned to work at all in the past few years?0 -

I think that you will find that on the transfer over you failed the assessment. That then puts an end to that claim. You can appeal but as you are now only entitled to EAS IB, you won't get any money.
Only those that are transferred from IB to ESA and pass the assessment get contribution based ESA for 365 days.0 -
This is incorrect, those transferred from IB to ESA who fail the WCA and appeal are entitled to the assessment rate for 365 days as an ESA(CB) payment and to ESA(IR) thereafter if they satisfy the means test.I think that you will find that on the transfer over you failed the assessment. So even having failed the assessment on the transfer, you would still get ESA CB - for 365 days be it by way of assessment basis on appeal of Working group.
That doesn't tally with what someone told me this week who happened to fail the ATOS assessment on transfer about 6 months ago. They were told that the CB protection afforded by IB was lost if you failed the ATOS re-assessment.
He can't claim either (ESA or JSA) Income Based because his partner works.
He never appealed against the ESA decision as that was the information that was given to him when he telephoned the BDC at the time.
He isn't going to be a happy bunny when I speak with him in the morning!!!!!!!0 -

never ever take the advice of a JCP call center staff they are not there to help you or advise you just merely a messenger boy to put input into PC and e-mail relevant department and even then they get it completely wrong at that department. its always better to call the likes of CAB or a charity to clarify what you have been told.
he could still mate a late appeal based on misinformation provided at time of seeking advice from them, they will investigate the misinformation and if it seems he was told he had no base to appeal the decision to hear the appeal will be a positive one.0
