Virgin Active Gym Overcharge

I'm wondering if it is possible for me to obtain a refund for being overcharged by Virgin Active Gym.
Last week I went to cancel and seek other options for my membership, it is currently a standard corporate rolling month contract for my company which I can cancel at anytime durning the year. My current fee was £61.00 but I was advise that my company deal was actually 49.95 and that I could switch to this and keep the rolling month contract as before. Great I said, but I asked why having I being paying the higher right for so long? Why was I not advised of the drop in price?
The reception desk admitted to me their had been problems with notifying members, some letters had gone out , but not reached everyone, some emails had gone out , but not reached everyone, staff members were also catching members as they walked through. I was never once contacted by letter, email or by a member of staff (especially as I had to get a new card when it was lost, a prime time to be told of the rate change?).
On speaking to the local gym manager I was advised that I could not get a refund and that none of the above that was told to me by reception was true! As far as she was concerned it was not up to them to advise me of the new cheaper rate and that if I had not turned up and asked about my contract options I would still be paying the higher rate.
This seems unfair as the contact I am on was for my company, but the rate changed last year and I continued to pay the higher rate of £11 for 15 months? I must be able to get this back? But how do I go about doing it and will I be able too? The manager seem to think I had no case?

Did the rate change for your deal or did they just change the standard price for new members?
They have no obligation to advise you of new deals and I suspect this is more of a case that they changed to price of the deal but existing members contracts still stood.0 -
I’m currently on a corporate scheme with my company and they change the price of this corporate scheme to 49.95, but I was still paying the old rate of £61.
I’ve been with them for 4 years and they had me on the system as being under the corporate scheme for all that time. Do I have a case to obtain a refund?

If I go to O2 and enter in to a contract for £30 pm for x handsets, i'm contracted to pay this sum. They can change the price of this package to say £20 per month, but i'm already on a £30pm package as per my contract. This doesn't mean they have to reduce the price of existing contracts, nor does it stop me taking out a new contract at the £20pm and cancel my existing contract (subject to their terms such as min.period, notice required).
Doesn't sound to me as though you have a case. Unless you was advised your contract would be reduced to the new rate or linked in any way.0 -
