Hotel Damage

From the T&Cs of one of the Thomas Cook groupWe will hold you and the members of your traveling
party jointly and individually liable for any damage to the
accommodation, furniture, apparatus or other materials
located within the accommodation, together with any
legal costs we incur in pursuing a claim. It is your
duty to report any breakages, defects or damage to an
appropriate person immediately.0 -
in over 30 years of travelling never caused any serious damage so no shocks so far!
If they expect guests to pay for accidental damages then they should make that clear to guests before they book a room.
As you said you are SURE that hotels do have insurance for such damage, therefore I expect that to come into force if something is accidentally damaged!
I'd suspect you haven't done much travelling to hotels with drunken teenagers stumbling around at all hours of the day and night though!
Maybe in a countryside retreat in England the hotel would be fine claiming on their insurance every now and again, but it certainly isn't viable in a Spanish party town! Particularly once you factor in the excess as well (which wouldn't surprise me if it was more than €300).
And when I said I'm sure they do have insurance, I didn't literally mean I'm sure - it's just like you, I'd personally assume they did. Plus they generally do tell you before you book - but then again, what teenager on a party holiday will sit and read the T&Cs!0 -

In defense of the lad, on our last trip to Barcelona the other month our 14 year old came a cropper with a balcony door, walked straight into it think it was open, we were lucky he didn't break but it is easy done, drunk or not0

Really, never heard of anyone else taking out holiday insurance when going to stay in hotel in UK. So if you go to say London for one night do you take out specific insurance or do you have annual insurance that covers you?
I have home insurance, car insurance and when I go abroad holiday travel insurance. But never insurance for UK for overnight stays in hotels.
I do on an annual policy0 -
I thought hotels in most countries require the guests to pay for any damages that they cause, isn't that the reason that in countries like the USA, they require a credit card swipe when you check in.
However, back on topic, if they paid for 3 rooms and were given 2 and the rooms were cluttered because of this then I would be having words with TC, we are talking Magaluf, drinking and partying is why people go, that in mind, the rooms should be safe, I would blame the overcrowding and kick up a real stink about it.I hate football and do wish people wouldn't keep talking about it like it's the most important thing in the world0 -

Agreed I thought damage should be paid for, I also agree that a complaint should be made when only 2 rooms were suppiled instead of 3.
I dont agree that clutter caused the glass to break, to much alchohol was to blame IMO and a lesson learned.
To much of, its not my fault these days0 -
After the holiday I really would complain about that charge. I'd be expecting safety glass which wouldn't require multiple stitches if you were to fall through. My husband when he was younger twice went through glass doors. One was at our University digs and I know it was replaced with safety glass.
Ultimately your son suffered a physical injury and they suffered a minor financial loss and really - they should have a tougher, safer product in place.
I have no idea about whether you're entitled to the money back, but I just thought I'd say that I'd certainly ask for it after the holiday.0 -

Do you know the h and s laws in spain? i dont, so have no idea what type of glass they should have.
If they have broken the law then they should pay, if they havent it was an accident brought on by alchohol...it happens0
