Indeed it is. Lloyds TSB will have complied with it if they explained that they require more time and that the complainant can now go to FOS if they wish.
Since 50% of complaints are apparently fraudulent try it ons, presumably the timescale would be considerably reduced if they did not have to deal with them.
The MOJ has told CMCs, in Claims Regulation Bulletin number 15, "It is your responsibility to ensure you have made sufficient enquiries with your client to establish whether they have a PPI policy and whether it was mis-sold to them."
In Claims Regulation Bulletin number 14 it told them "read the letter from the Ombudsman and ensure you are following this guidance before submitting complaints to them. We fully support the guidance issued and will be checking compliance."
In that letter, FOS says it expects firms to have "Completed the payment protection insurance consumer questionnaire as fully as possible – and sent it to the financial business to help it assess the complaint."
Yet I have NEVER seen a complaint from a CMC which includes the questionnaire.I've got my head in my hands.
General Rule 3 on page 4 of the Conduct of Authorised Persons Rules 2007 says "A business shall be directed by people with the necessary competence."
General Rule 4 on the same page says "A business shall ensure that any staff or other people working on its behalf have the necessary training and competence to perform their duties."0 -
but thats a lie 50% of the claims made are not fraudulent0

Yet I have NEVER seen a complaint from a CMC which includes the questionnaire
- this just tells us of your own limited experience, as there are thousands of claims submitted every day by companys who i wont name on fos questionnaires , its the only way a claim can be submitted
i think your confusing the issue, try this one, every day thousands of claims are submitted by cmcs on fos questionnaires and the bank replies by sending either the cmc or the client a blank fos questionnaire to complete, care to discuss?0 -

yes and join a 2 yeah queue every growing which will probably reach 3
not much of a choice is it , you are better off waiting another 8 weeks, therefore lloyds will take 16 weeks and get away with it
consumer gets screwed over and is stuff between a rock and a hard place due to bank dirty practices, once again , still going on, every day
not that that is any of your concern, which is ironic on a consumer web site

For what it's worth, I don't think magpiecottage is the person to be having a go at. Some of the most clear, concise and helpful information on the PPI threads has been given - free of charge and in their own time - by magpiecottage.0 -

So I think my experience of what CMCs is likely to be as there are thousands of claims submitted every day by companys who i wont name on fos questionnaires , its the only way a claim can be submitted
You claim to work for A claims management company. There are hundreds out there.
And Moneyineptitude has raised the possibility that in fact you do not work for even one but simply come on here to get some kind of perverse pleasure out of winding people up.
There is clear merit in that view since, if you did work for a CMC, you ought to know and follow its rules, rather than arguing that they do not really exist.
Either way. You can only know how a maximum of one CMC works.
For you they are outgoing and only go out from one place.
I get them as incoming and they come from all over the place. I will let others judge but I think I am probably in a better position to know.
And the fact is that I do get PPI complaints to deal with and I have not yet had one that included a FOS form.try this one, every day thousands of claims are submitted by cmcs on fos questionnaires and the bank replies by sending either the cmc or the client a blank fos questionnaire to complete, care to discuss?0
