help regarding MOT and fault afterwards

Hi
i had my Mot done two weeks ago and passed with flying colours, now i have just parked my car in works car park and my car has just rolled down the hill in to another car, now the handbrake was on so its obviously faulty
so i spoke to MOT place, they said it must be loose asked if this is something they check on MOT they said they do but it must have happened after.
is there any sort of fault from the MOT place ?

I can't see how they can be at fault, but bear in mind a lot of cars "develop" faults after an MOT simply because its the first time in a year that they have been put under any kind of stress. In fact it used to be quite common, and alarming, at the number of BL derived cars that would choose to burst brake pipes while under test.0

No "fault" with them for the accident but possibly for passing it if it shouldn't have - it depends why it failed.
If it was something visible that they missed (such as a bacdly weakend visible cable or an obviously faulty ratchet on the lever) then you should speak to VOSA. Seeing as you're within a month of the test, you can do this anyway if you're unsure / unconvinced of the cause and they may suggest re-inspection on an "inverted" appeal. You don't pay for that but they might find further faults because it'll be a full re-test by one of their testers.
If they find fault with the original tester then you could try chasing the garage for professional negligence but it'd be an up-hill struggle through the courts.
Might be worth talking to the garage and politely letting them know that you think you need to start an appeal. They must give you the relevant VOSA form if you ask and they might decide that helping out with the repairs is a better option if there isn't major damage.0 -

Now if you just had the vehicle serviced then you can go moan to the garage.0 -

went back to garage they said they were too busy to look at it and it probally developed after they tested it, i have got it booked in to another garage tommorrow morning to have it looked at0 -

This bit raises slight alarm bells. Doesn't take more than a few minutes to look and see if it's failed at a visible point so it suggests a real lack of interest to be "too busy" to check. I'd be inclined to be phoning or popping back in for an appeal form before going to the other garage to make the point that they should be taking an interest!
Also, be aware that if you get the other garage to do anything other than look at this point VOSA won't be able to help you - the car mustn't be repaired in any way if they're going to re-examine because (obviously) that can affect what they find.
The "at the time of test" stuff about MOTs isn't cast in stone, which is why the "inverted" appeal process exists.
Up to a month after a test mechanical faults that should have been visible at the time (say, a heavily rusted visible cable or a ratchet that fails if you knock it sideways) can be looked at by VOSA.0 -

No they won't - appeals against a pass ("inverted" appeals) are always free. It's only if you're appealing against a fail that they charge.0
