    Unless Halifax voted for it at the creditors meeting or failed to vote you could not have one as Halifax have way over the 25% of your debt needed to block it.

    Yes Halifax voted for the IVA as it is listed with the Insolvency Service as my name is on there and IVA number.

    Halifax were just being a bloody nuisance because they panicked after lending me all that money because they know that they wont get it back!!

    DFD said it was quite usual for harassment to continue for a little while after IVA was issued.

    I am foning DFD today to seek to see if I can change to a Debt Relief Order, as I dont fancy paying £130 for 72 months which to me seems to be a bit too long!!
  • A company called TIX vote for HBOS at creditor meetings so as it is an external agency often it takes a while for the call centre to remove the client from the auto dialler system.

    I would tell DFD that you feel you were wrongly advised and that you have sought advice and know you were eligible for a DRO and see what they say.

    I dont think they will be very helpful to be honest and you may find that if you want to apply for a DRO you will need to let the IVA fail by missing 3 payments.

    How much debt went into your IVA?

    You could consider allowing your IVA to fail and then going bankrupt or if you are eligible a DRO - only problem you may have is saving the bankruptcy fee but you could save the money you are paying into your IVA for 5 months?

    If you income is soley benefit you could not get an IPA

    I agree. Bankruptcy would be a far better option, you can get advice elsewhere you know!

  • In as much as I'm sure you'd like to contribute payment to your debts - I'd have thought bankruptcy would have been a better option for you.

    Thank you keeleyjadex for the support you have shown. Most replies I have had have been rude and abusive but thank you for being understanding about my situation. The fact is Halifax kept increasing the credit limit on my credit card without asking me which I thought that they had to. I wanted the limit to stay at £1000, but is now £9500. They kept increasing it every time I paid the card off. They never asked me for my income or expenditure when they gave me credit either.

    The fact is Halifax kept increasing the credit limit on my credit card without asking me which I thought that they had to. I wanted the limit to stay at £1000, but is now £9500. They kept increasing it every time I paid the card off. They never asked me for my income or expenditure when they gave me credit either.
    Did they force you to spend it? Sorry I'm a bit confused as the thread is from nearly 6 months a go.

    No, for some reason procdolydin1985 is C&Ping people's posts from old threads. They have posted several time today, (all seemingly relevant posts as they've stuck to the topic ;)) 1 minute apart.
