Iva in place but halifax wont stop harassment

I successfully applied for an IVA with Debt Free Direct on the 1st June.

Since the 1st June, my main creditor Halifax, wont leave me the hell alone.

For 2 weeks after the IVA was applied for, they rung me every bloody day causing me distress.

Each time they rung I had the same conversation with them about the IVA; they have not taken a blind bit of notice about it.

The other day they sent me a letter saying that they past the debt onto Lloyds Collections Department!!

I contacted DFD who immediately sent Lloyds the IVA paperwork.

I just cant understand why Halifax wont leave me alone and just accept the the IVA is there; I've had to make a formal complaint to the Financial Ombudsman Service and DFD said if I still get harassment from them in September they will get in contact with Halifax and tell them to back off!!

The fact that they kept ringing me every day for 2 weeks after the IVA was issued drove me up the wall and made me feel ill with stress.

If Halifax hadn't lent me the money in the first place, I wouldn't be in this mess and I am looking at legal advice to see if Halifax lent to me irresponsibly, when they knew I was unemployed and on benefits.

    This is supposed to be a friendly forum and not judgemental.

    I dont expect people to be rude about a person's circumstances.

    I have evidence to prove Halifax lent to me irresponsibly.

    DFD advised me to do the IVA.

    If you were struggling with your debts, how would you cope?

    What gives you the right to be judgemental!!??

    Its YOU rh41 who needs to grow up and I hope one day you will find yourself in the situation I am in!!

    Its not fair I lost my job and cant pay!!

    Seriously. You borrowed the money. You spent it they never held a gun to your head.

    I agree with rh41! You should have got a job, any job or sold the things you bought with their line of credit.
  • It's unfortunate that you found yourself without a job and debt to pay, but to try to seek legal action because you spent money you can't pay back is a little OTT.

    Everyone messes up and that's fine, but you can't try to blame someone else for your mistakes. You applied for the credit and based on the information you gave, Halifax agreed to credit you. Halifax didn't ask you to apply or force you to spend the money so I really don't understand why you'd think it's their fault.

    You were irresponsible for spending money you can't pay back but well done to you for getting something in place to get it sorted.

    Thank you keeleyjadex for the support you have shown.

    Most replies I have had have been rude and abusive but thank you for being understanding about my situation.

    The fact is Halifax kept increasing the credit limit on my credit card without asking me which I thought that they had to.

    I wanted the limit to stay at £1000, but is now £9500. They kept increasing it every time I paid the card off.

    They never asked me for my income or expenditure when they gave me credit either.
  • That's OK.

    The main thing with a credit card is being responsible enough and have enough will power not to just go crazy with it.

    I have about 3 credit cards and all applications have asked for my income so that's strange - I wouldn't of though they'd offer you anything if they hadn't asked? Expenditure - well that's down to you really. Making payments that you have afford and manage.

    If I were you, continue to pay the card but cut it up and don't dwell on it. What's done is done but atleast it's in the process of being worked out!

    yes i agree , and some of the people you talk about will also be in the same situation soon ,as redundancy to all will come at some point, i have always believed with this situation both the creditor (which has been proven) and the borrower are at fault, being in debt IS NOT a crime and would guess people in the same situation as yourself has been purley brought on by unemployement or unforeseen rising costs or disability etc etc making every day living a impossability to alot of people , prob 75% of the population in fact, i guess all the people who have commented on here are in debt and can only control that debt whilst they have no other issues, creditors have been targeting the vunerable to lend there money to , this is there biggest profit are usually because these people very rarley pay the full amount back each month , without those people credit cards would not excist, but you do have a responsability dear, but i strongly favour the creditors irresponsible lending techniques to be at fault , :T
    most or all credit card spending is for everyday living, paying bills etc, people are not spending on new cars or jetting off or spending in high streets shops anymore, proving debt is being used to just get by for the everyday needs
    im guess ing you have been advised to go on a IVA purley down to having very little capital in your property etc ?

    If you cant be constructive with your comments then dont comment. People come here for advice not to be judged????? Most people know they have done wrong and are trying to put things right!!!!!! Some sad objects pretending to be humans about!!!!

    Anyway when I had applied for my IVA I was still getting 4-5 calls a day from my creditors but I continued to tell the I was applying for IVA. They then asked with who? and then the call started to subside...I would just go with the flow for a few more weeks knowing that you have attempted to address this problem!!!

    What can Mumz2bee say to Halifax if they keep calling and making demands on her?

    What would you tell them if you kept getting the calls and were in an IVA?

    Could she just say something along the lines of "There is an IVA in place so legally you can't do anything. In addition I have made a complaint about you to the Financial Services Ombudsman, and I am also considering reporting you to the Police for harassement?"

    I know as Keeley says it may be a bit OTT, but when you keep getting demands made of you when you're in that situation it can seriously affect your health. You become physically ill, stressed and greatly worried.

    There has to come a point where the constant phone calls then become harassement?

    I would definitely keep a log of the phone calls. I would also ask for the name of the individual calling each time, I would not go through their security checks but ask them to go through yours, and I would finish the phone call my asking for the name of the CEO of their bank and an address where I could write to them.

    I would also re-state to them that you have already informed them several times that an IVA is currently in place and that you recommend to them that they resolve their internal communication issues as you are being contracted numerous times by different people within their organisation about the same thing which constitutes harassment. And I would probably if I was feeling extra annoyed ask them what part of IVA do you not understand?
