Iva in place but halifax wont stop harassment

I got an email today from my IVA provider Debt Free Direct.
The have foned Halifax Collections Department on my behalf and they have asked for them to stop harassing me because of the IVA.
I too also kept telling Halifax of the IVA every time they rung but they ignored what I said.
The fone calls I had were every day for 2 weeks after the IVA was granted, then I started getting letters, which I have kept as proof of harassment.
The Financial Ombudsman Service has also written a complaint to them regarding this matter also.
DFD said because of my finances and that I dont own any property, an IVA was the best option.
I did try to pay my debts before this action, but I couldnt cope any longer.
I cannot work due to having ill health and a disability.
I was getting fones calls every day from Halifax who was the worst harasser out of all my creditors.
Hopefully with DFD foning them telling them to sod off, hopefully Halifax will now leave it alone!!
DFD said that after they rung Halifax, if they still persist in contacting me, they can take action against them for breaching the IVA continuously.
Would like to say thanks to all the above posts for advice; much appreciated that there are some nice people out there who are not judgmental!!
Best thing I ever did was an IVA!!0 -
Don't listen to anyone who calls you on here, they are misguided at best and downright nasty at worst.
Let he who is without sin cast the first stone.
You are legally protected by your IVA, which is more than can be saud for 99% of the people on here.
Anyway, 2 ways of getting rid of this.
1. When they ask you a DPA question, e.g DOB, get it wrong.
2. Answer the phone, tell them that you want to speak to them but need to turn thr kettle off, can they hold? Go and watch the telly for 5 minutes and they will not be there when you come back. 2 or 3 times of either of these and problem solved.0 -

i have a dro made in the courts in june this year, had 11 different accounts included. i was paying them all every month, but then lost my job and still tryed my best to keep up but with 2 little kids as well i found it so hard so i got a dro. 10 of the companys sent me letters saying they accepted the dro and no futher action would be taken but the 11th one claim they never recived any paper work and as i had not made any payment they put my debt up another 600 and passed it onto a debt agancy. then i was getting phone calls 2-3 times a day keep telling them it is a dro and their is nothing they can do, i asked for their address as it was listed as a po box address so i could sent paper work out, he refused saying we can't do that, we will send out a debt agent to collect paper work and they will charge me for that. so i phoned royal mail gave them the po box address and they provided me with the address in full, then went onto companys house put in their licence number and also got their reg address, so sent letter to each of them via recorded delevery. a few days past and their it was the phone call saying how much i still owed and they was going to court, i informed them letters had been sent out to the address and signed for and was told i could not sent letters out as was a po box address told him address i sent it to and he went mad as i found out the address, then informed him of the companys house address and asked was that the head office or just a made up address as fos would love to know, he then came back to me and said no further action will be taken and they had now taken all charges off my account. just goes to show, be strong and play them at their own games, don't get stressed out just do a little research and send letters out recorded delevery then nothing can happen to you. everyone has problems with money from time to time, it happens, nothing to get too upset about we all try our best, just do whats right for you and try and pick your selfs back up.0

Hopefully with DFD foning Halifax last week to remind them of the IVA, I have not heard anything since now!!
My IVA was set for 72 months; I would have preferred to have gone for full bankruptcy but DFD said no.
Halifax were the only creditor who continued to harass me after the IVA was issued, now they have left me alone!!
Its piece and I didnt have to change my fone number!!
Thanks to everyone for their positive feedback apart from the odd rude one!!0 -
Hi MUMZ2BEE i am glad halifax have stopped calling you :-)
Just out of interest on what grounds did DFD advise against bankruptcy?0 -
They didn't they just said an IVA was better!!
I have asked though my DFD advisor if I can change it to bankruptcy or a Debt Relief Order.
I dont own any property and I am not financially linked to my partner so I cant understand why they said no to bankruptcy in the first place.
I for one would prefer it as I wouldnt have to pay £130 a month for 72 months which for me is too long!!
As I am on benefit, I could loose my DLA next year as they are making changes to this benefit so I could loose it in the long term!!
I need to state this to DFD which is why i want to apply for full bankruptcy instead of having an IVA!!
And I dont want further credit anyway!!0 -
On Benefits, no property and they still recommended an IVA??????
How much debt went into your IVA?
You could consider allowing your IVA to fail and then going bankrupt or if you are eligible a DRO - only problem you may have is saving the bankruptcy fee but you could save the money you are paying into your IVA for 5 months?
If you income is soley benefit you could not get an IPA0 -
Amount of Debt as follows:-
£7,000 Halifax Personal Loan - AFTER interest it went up to £10,000
£3,200 Halifax Credit Card
£995 Virgin credit Card
My benefit income totals to around £800 per month.
They recommended I pay £130 a month for 72 months - but I think its too long!!
I have asked DFD if I can go onto a DRO or bankruptcy but they have not responded to my email!!0
