I stated in the listing that due to numerous parcels going missing that i would post first class with proof of postage but strongly advise to request recorded delivery at the end of the auction for a further cost of £1.00 but this service would only be added on request and if the buyer did not choose this option then i would not be held responsible for items not recieved and if the bidder/buyer was not happy with the terms they where asked not to bid. Can anyone tell me where i stand with this.
If you put T&Cs in your listing like this, then you are setting yourself up for scammers.
It is the SELLER, and the seller alone who is responsible for making sure the item arrives with the buyer in the condition it was sent.
They buyer knows this, so you make it too easy for them to claim the item has not arrived.
In future, any item over £40 needs to be sent SPECIAL delivery or courier with tracking, at your OWN cost.
In this case, you can just refund the buyer and try and claim from Royal Mail.Should've = Should HAVE (not 'of')

Wow. A £100+ Barbour coat sent first class? The mind boggles.
That said OH won a Belstaff a few years ago at just a smidge over £100, never arrived and the seller had sent it first class as well. Felt sorry for him really, filled all the forms in for Royal Mail etc when they came but it never did turn up.0 -

I hope you learn that anything of value needs to be sent Special Delivery or via a courier with insurance.

There are several regular posters on these boards that never sign for recorded. It isn't a recommended guaranteed way of ensuring you win a case, as it isn't reliable. BTW, the OP didn't use recorded delivery that I can see.
If you are a power seller with any volume, you may feel something like RMT more suited. It is a real tracked service, unlike recorded delivery.0 -

I am one of the many regulars here thAt never have to sign for. Recorded item, I got two yesterday left while I was at the sorting office dropping off my own mail.
I would of course urge all of my competitors on eBay to spend the additional 95p per item as it certainly helps my sales!
