I'd send the original form as completed, but add the additional info you wanted the Bank to consider when you wrote back to them. Make sure FOS is aware that you wrote back to the Bank (at their behest) and they then refused to even look at it.do i have to use the same details i used for the initial complaint or can i flesh it out a little now i know more
I wish you the best of luck with this one, Burt, I really do!:)0 -
thanks
would it be worth doing a covering note, explaining what each document is and the sequence of events? that way i wouldn't have to edit the form but can add all the explanation i need, I'm assuming they don't just use the FOS form when they take into account any decisions?
basically i don't want to repeat my first mistake and not include all the info in the initial complaint!0 -
Don't forget, FOS will also be privy to information sent to them by the Bank; so the sequence of events should be quite evident.thanks

Having said all that, I think writing a cover note, explaining that you believe the Bank failed to note front loading/single premium when considering your complaint, is essential.
You can never provide too much information (unless it's irrelevant, of course) and, as you say, you only have one more chance to get your message across.
I do hope to see you continue on the Forum while you are awaiting your adjudication, your contribution has always been both informative and entertaining! :T0 -
oh ill be sticking around for a while

the thing that is odd with this is that in their initial rejection letter (the one in which they said send more info) they did recognise it was single premium, but said that it was fine with sales practices at the time (or something along those lines - don't have the letter with me) - if this was the case then nobody with single premium would ever get a case upheld on that basis?0 -
The fact that front loading is statistically the most upheld complaint at FOS should give you more confidence in the eventual success of your claim.:)they did recognise it was single premium, but said that it was fine with sales practices at the time if this was the case then nobody with single premium would ever get a case upheld on that basis?0 -
just find the whole complaint and the way halifax have felt with it completely odd!0

Well, I've no idea how they feel about it!:Dthe way halifax have felt with it is completely odd!
Seriously, it sounds like the rejection letter is one of those form letters which invite you to take action in the hope that you won't.
Case in point,
"you can reply if you have further information" translates to "We've said everything we're going to about this, but don't want to appear too abrupt "
Or "You have the right to go to FOS"
translates to
" We hope you think this option is too much hassle"
and so on...;)0 -
yeh your right, i suppose there just hoping its a try it on complaint and as they have loads to deal with, i shall send everything off to the FOS and hope for the best
thanks for the help, will keep this thread updated when i hear more!0 -
Hi burty8899,
Had to respond to this thread. I've just had a Halifax rejection also claiming they know it's single premium ppi but that they feel this was fine. I though did not even put about it being single premium in my initial questionnaire.
I was totally gutted and thought single premium was also always wrong?
Strangely though they also wrote that I cancelled my ppi cover in the cooling off period and then went on to dispute all my reasons for the complaint. I did not cancel the ppi and can prove this as my loan payments were for the amount stated with the ppi. If they genuinely thought I cancelled it why would they write 3 pages on why they won't payout?
I am gonna call on Monday.
Don't want to wait ages going postal route only to be rejected again.0
