Seller taking too long to send item

I was the winner of the following Auction -

On the listing it says -
Please read below before paying for goods. Please choose the proper postage for you item to be posted
N.B: items that are bought and are over the value of £150.00. These items will not be posted until money has cleared through whatever method of payment that has been used
I assumed this meant that if I was to pay via Bank transfer or cheque, the seller would wait until the cheque had cleared or them money had reached his account before sending the item. I won the item on Friday night, and it says on the auction he sends items that have been won before Sat 11am on saturday, so I assumed I would have it for monday. I emailed the seller when it hadn't arrived and he said if he is being paid for an item worth £150+ he "has to wait till payment has cleared through paypal - I do this to avoid chargebacks". I always thought paypal payments were immediate so I can only assume he is talking about until he has transferred the money from paypal into his bank account - This is going to take about 5 days. Do I have to wait, or should I have got the item by now? Thanks

Once the money is in a seller's PayPal account then the item is deemed as paid. It makes no difference whether they transfer it to their bank account as the money can still be reclaimed anyway. They shouldn't make you wait for the money to go from PayPal>Bank account.-->♥<-- Sugar Coated Owl -->♥<--

I received an email from you stating the phone would be shipped when payment has cleared through paypal; I don't quite understand what you mean by this, I paid by paypal yesterday night - can you tell me an approximate date for when the phone will be shipped ...Thanks
I received this back -
This will take 3-7 working days to clear. As we clearly stated in the auction when the goods will be shipped we hope that this will not effect you feedback score decision. Yes, I noticed that in the ebay auction but assumed it meant if I was paying by cheque/bank transfer - I always thought paypal payment was immediate. Obviously I won't let this effect my feedback score, But I would appreciate it if you could get the phone to me ASAP - I assumed it would be delivered on monday...Thanks

This is our policy as we take every step possible to avoid fraud using eBay and paypal.

You could email him back and say 'I paid by paypal, there is no clearing time, it's instant. Please confirm when you will be despatching. Thanks' but I wouldn't hold your breath for a sensible answer.
Are you positive you didn't pay with an echeque? These can take 14 days or more to clear.
If he's waiting to transfer your payment to his bank account, he's a muppet.My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
It sounds very much like the seller is waiting for the funds to transfer from PayPal>Bank account (it takes 3-7 working days to clear) Little does he/she realise this is pointless and doesn't prevent fraud.-->♥<-- Sugar Coated Owl -->♥<--

If you have paid through Paypal by instant transfer from your bank account or by credit card it is an immediate payment so they should have sent the item straight away0 -
i have to say that when someone from america bought a high value item form me i waited till i had the cash in my account ( i didnt realise it made no difference). Guess im a bit of a muppet...0

I'd simply get back to them stating a version of the below (snipped from posts above):
Once money is in your PayPal account then the item is deemed by Ebay as paid. It makes no difference whether you transfer it to your bank account as the money can still be reclaimed through a dispute, which puts a paypal account into a minus figure, ready for bailiffs to chase. You are mistaken if you think that clearing the money into your bank account affords you any more protection. As far as I'm concerned my part is done and the item should be shipped immediately. I look forward to your appropriate response.
Be sure to reflect in your feedback that the seller made you wait until they xferred it into their bank account.It's BOUGHT (to Buy), not BROUGHT (to bring) AND you cannot be frauded, only DEfrauded.
Please do not buy animals from a pet store. Visit your local sanctuary or centre and give a good home to an unloved or abandoned animal.0 -

Well, vtmil, just so you know:
If you delay despatch while you wait for the money to go into your bank account, this means
a) it's pointless, because in the event of a problem, either paypal claw it back from your account (legal or not, it happens) or plunge your pp account into the red
b) your buyer is unnecessarily irritated by the delay
c) very importantly, you invalidate your seller protection if you post later than 7 days after paymentMy TV is broken!

Sorry for the double post, But I was just reading another thread on here (paypal loophole one) and can you open a non-delivery dispute thing after 7 days? Is that 7 working days including weekends? Reason I ask is because if the seller replies saying he's not going to ship the item, I want to tell him something that will make him send it this week0
