My father in law (74) recently had a stroke, and i have become a third party authority at B...L.Ys bank. Looking through his statements I have found payments going to a barc.. loan since 2003 with 56 GBP pm to protection and 186 to loan total 242pm for 84 months, He retired with renal/liver failure in 1991. and been ill ever since. I have the loan agreement confirming these amounts. Next i look at the general running of the current account. and there are many years of 22GBP charges of unauthorised reserve (320GBP) sometimes 5 times a month i have counted some 39 times this as happened , the charges themselves ultimately take him over the reserve, sometimes by 100+GBP the following month. repeating this cycle time and time again. the over draft reserve as never been increased. but the loan was RECONCiDILATED in 2008 bringing down the payments to 184 GBP in total. now with 16 payments left to pay, he also has a Brcl CCard owing 270 GBP. He says the bank gave this top pay the charges and buy food. he has small pension of 150 pm, state pension , and 7.09 per week pension credit.
PLEASE CAN ANY ONE ADVISE ME how to get him out of this mess!!!

Try CAB or Age UK for assistance.
It may be that he should have been entitled to more / other benefits too.0 -

You could try the 'entitled-to' website (or whatever it is called now) to check how much he should currently be receiving in benefits.
Do you think he is entitled to Attendance Allowance also?
Re. the PPI, in what circumstance does it say it will pay out? ie. ill-health, redundancy etc.
There are template letters on this site to help you make a claim for PPI etc.
Do you know what he originally took the loan out to pay for?
I know in some towns Age UK have centres/shops that have drop-ins for advice.0 -
..have you got a local CAB or money advice project near to where you live? If so book an appointment and bring all the paper work, they are normally quite good at this sort of thing. Re the £56 payment protection , these have been recently been judged as mis selling so you should claim the lot back from Barc..., Re the current account charges I would again write to the bank stating your FIL health problems and claim the lot back. If they refuse both of the above write a letter of complaint to the manger setting a time limit and stating if matters aren't resolved you will take it to the Financial Ombudsman Service. With all the problems Barc..... are having at present I think they will turn out to be "diamond" ..geezers.........ed0

thanks for that, i have asked bars.. for statements 06/2003 to 09/2010 because i have lots of gaps . so there will be more . will CAB see me . has he is too ill . and not mobile. just came out of hospital sunday (3 times since 11/06/2012.) all emergencies
asked for forms for attendance allowance.via tel benefits end line. as he needs 24 hr care. and me sand wife doing are best

Send the complaint and put that this was Single Premium PPI and the full cost of this PPI and the unfair rebates were not explained fully at the point of sale, the unemployment and sickness cover that this provided was of no use as your Fil was retired with ill health in 91 and you believe he should not have been sold this PPI for those reasons alone.
As the loan was a consolidated one, you want the PPI from the first loan also as when this was consolidate, they will have given you a rebate of the PPI but the remaining PPI would have been carried over to the new loan, this is why the Single Premium PPI is the most upheld of all PPI reclaims.
Complain about the CC too, they had no right selling this card to a pensioner to buy food, this is disgraceful, banking at its worse.
With regards to the charges, put a complaint in about these too, give it to them with both barrels ! they sold PPI to a man who retired with ill health and then added charge after charge on the current account that he could not pay due to the limited income and so gave him a card to buy food and help pay the charges !!, let them know that Barclays treated him unfairly to say the least and that you will take this to FOS if they do not look at your complaint and remove all charges and compensate for the worry this caused.
I know if you overdraw etc charges have to be paid but I do not know of any pensioners who are " financially savvy " enough to see through SPPI and charges on charges.
Barclays have not done enough, in my opinion, with the charges they keep putting on, they obviously do not know the customer in this case.
If Barclays step up to the plate, you will not need cab.

Better to write a Subject Access Request (SAR) letter to the Bank. This will provide you with all information Barclays holds on your relative for the last six years and (sometimes) more.

As for the charges, do as Amersall suggested and write to the Bank detailing your Father-in-law's condition and how the Bank have taken advantage of his circumstances over the years.0 -

many thanks for your time on this ,filled in the FOS /barclays questionnaire and delivered it to the bank for the PPI part, awaiting statements after request as well. got FIL to open account at another bank. changed state pension, pension and pens credit to new account. Awaiting confirmation from these. then if he gets PPI back . then charges plus interest. would you then suggest walk away from 16 remaining payments on loan . CC debt 200 and close bar.. y account. FIL not worried about credit ref. plus i would put firewall around him. because of stress etc. too ill.
