Accident today..silly me didn't get a witness advice please...

    bargain banger for some, but for others, 2k is a lot of money to replace out of own pocket

    and those 35k porches, how easily can their well off banker owners replace them if they are written off

    A passenger in a vehile involved in an accident is not considered an 'independent witness'.

    Whether in the car or not, related to the driver or not, she is still a witness and her evidence can be used in any proceedings in relation to the accident. It is for the court or other adjudicator to assess the level of her independence and whether that has any bearing on her evidence.

    My 2pennorth,

    Let the insurers sort it out, that's their official stance anyway, person in car is not an independant witness.

    Always deny anything at the roadside, standard advice.

    And inspite of what others have said do call the police, adds weight and conviction and at least you get a "crime number"

    None so you won't get a crime number.

    You'll be lucky to be given any more than the advice on here.

    Friend was hit by a driver pulling out of a junction to turn and the Police prosecuted them for driving without due care and attention.

    It can happen. Mind he was on a bike and injured as a result.

    not quite correct, i had a near accident a few months ago, no collision because i swerved out of the way. spoke to one of my mates who is a cop who told me i should report them. reported them, and she got the choice of being prosecuted for driving with undue care, or attend the course. driver chose the course and i have full ref numbers etc

    Thanks all. Ins co confirmed today that driver will not accept liabilty, they think she's going to say I ran a red light :( . Dont have her full statement yet but should be in receipt of it by Friday.

    Ins Co valued my car at £2k on renewal, I actually dont think I'd get 2 quid for it!

    Never said it was a crime I said "crime number" in inverted, it would be an incident No. Unless you really do want to be pedantic which judging by your next post you did?

    I's still advisable as on your claim form you will be able to clearly and honestly state that the police were informed and the call logged.
