    The simple answer is when it's of evidential value. You matter didn't go to court so why waste a few hours on a statement?

    So how does one discern a statements evidential value without taking the statement?

If you were to meet a bike while going around a bend with another car coming in the other direction, so you get the initial glare, well I doubt they'd be seen in their black clothing & dim or no lights. You can get those hi vis jackets for almost nothing, I cant understand why they dont have them!

    Do you think having high viz renders your impervious.
    This is typical of a thread relating to cycling.
    What some cyclists do doesnt relate to all cyclists.
    I can tell you from painful experience. Wearing high end gear and high end lights doesnt mean a driver wont simply decide to plough on through.

    Yes Mark Im clueless in thinking the police may have to take a statement, to decide if there's a case to follow up.
    What am I thinking..

    My point is cyclist should all wear hi vis vests & have decent lights on their bikes, if they want to ride at night, especially on unlit country lanes.

    Right,but thats a given. (and law in the case of lights)
    If some cyclists choose to do so,then its their lookout.
    However its not really relevant unless you have a legal case in mind where it is relevant?
    I know of at least one case where not wearing a helmet was cited as a mitigation for a lenient sentence of a driver who killed a cyclist(the 2nd cyclist he had killed) despite it not being a legal requirement. Have a view on that?

    But I dont want to injure or kill someone on a dark country road because they are riding without lights:(

    and I dont want to be killed
    sadly when this happens,it seems many drivers get a free pass regardless of their actions.
