Oh and please don't use a claims handling company who will probably charge an extortionate amount (perhaps almost half of any reclaim after VAT is taken into account).

If you feel care fees should be being paid, speak to social services who will assess the individual and provide a report. With that you can then approach whichever authority you think should be paying directly.

Note that strict rules and restrictions apply for the backdating of Attendance Allowance, so if applicable don't lose out further, apply today :)

The claims handling company just sounds like an easier way of doing it though. Is it easy to do the claim yourself?

I have gone through a claims company - simply because I don't understand the intricacies of the rules. It looked a bit more complicated than whether or not the primary reason for care was a healthcare need as the assessments took into account the complexity and severity of this need. My grandad needed 24 hour EMI care, but just had one daily visit from a registered mental health nurse, so I don't know whether this should have qualified for continuing care or not. It is quite stressful looking through his notes, so I thought would take some of the upset out of it by going through a claims company.

My mum is shortly to go into a home and on reading her care assessment plan, they say she needs MHA 117 aftercare. I thought this meant that her care should be free but she is having to self fund it. She will be moving into a different authority and area. I telephoned the alzheimers society and they said she should be having free care but when she moves, the new authority will re assess her and probably take the 117 off her! Why would they do this?

Incidentally, in the notes I have been reading it seemed to state quite clearly that the continuing care assessment is a national one and not regional - therefore should not depend where she is.

There is lots of information online about it. The one I found was a pdf. I'll see if I can find it again for you..
  • This was the guide I found - very helpful!

  • Many thanks for this thread, my mother in law suffered with Alzheimer's for over 22 years and passed away a couple of weeks ago. We had to sell her home several years ago to pay for the nursing home fees. Many years ago she made a will with a third of her estate going to her grand children. We feel very angry about all her assets have been used for nursing care and would like to pursue a claim but do not want solicitors again taking money any assistance would be greatly appreciated.
  • Yesterday I started our journey to reclaim mum's nursing care home fees and to get the ball rolling phoned.

Alzheimer's Society National Dementia Helpline England and Wales 0845 3000 336
    Northern Ireland 028 90664100
    Monday to Friday 8.30am-6.30pm

Tried the "say no to 07870" and got the following

Society Dementia Helpline 0845 300 0336 - 020 7423 3500 Ask the switchboard operator at the Alzheimers Society to be connected to the dementia helpline and they will put you through to it.

However the switch board said the line was very busy and gave me the 0845 number again. So rang that and got straight though to a very nice lady who said they have a booklet on reclaiming and will be sending in the post to me. However she did say there is a very strict criteria to follow, any way will see what that brings. Will keep you posted.
  • Good luck with this Jim. Our application is being processed by a care home claims company. It was hard going through the medical notes, to get the information they needed, but hopefully will see some results from it.

I hope all goes well for you, I know it's a bit cheeky but could you advise me the type of information required from the medical notes , cheers Jim
  • Well got the brochure from Alzheimer's Society and it's a long read and looks like it deals with people still in nursing care however still reading.

In the meantime I have rang mums bank to get a statement back from them for the many years we have been using her assets from the sale of her house. By the way that was Nationwide and they were very kind and are dealing with the statements and should take about a week.

Also made contact with the doctors for medical records and currently going from pillar to post trying to find out how to retreave them.

I am going to ring the nursing home tomorrow to see if I can get copies of assessment's for when they were checking her needs for ongoing care by NHS which she did get later when all her assets from the house had been used. I think I will need to prove she required this a lot sooner and not when they thought she was near the end.

I am not sure at this time if I am going in the right direction and any help would be gratefully received
