Care home claims ??????

Hello Folks!
I've just seen a "PPI" styled TV advert alluding to reclaiming money from care-home fees...
I'm just wondering if anyone knows anything about this?
Advert suggests that claim can be made even if party in question
has passed away.
This is very interesting for my family, as my late grandfather
paid out quite a lot of money over 2 and a half years.
Perhaps the distinction is care home // nursing home....
Is it due to nursing falling under NHS purse?
Any info gratefully received..
I have found the following website, but suspect that this will be a similar
set-up to PPI - why pay commission when you can claim in person blah blah.. (also prefer to trust this website!)

Does anyone know of any more posts about this? We had to sell my Grandad's home to pay for his care home fees and he suffered from dementia. I would really like to know whether this is something we should be persuing!0

So would I...
Some input from Martin would be good - clarity needed I think.0 -
My mum is shortly to go into a home and on reading her care assessment plan, they say she needs MHA 117 aftercare. I thought this meant that her care should be free but she is having to self fund it. She will be moving into a different authority and area. I telephoned the alzheimers society and they said she should be having free care but when she moves, the new authority will re assess her and probably take the 117 off her! Why would they do this?0

I cannot speak with any claim to great knowledge in this area,
but when my Grandfather was alive, I recollect talking to Age
Concern...
Gist was: care home should be FREE if NHS ...
At the time he was in a private home - was under the threshold for
savings, but his pension was utilised to go towards his care - something
I did not agree with....
Anyway: key thing I would say is make good use of AGE CONCERN etc ..
as our interpretation was that social services were encouraged to tell
you as little as possible about funding - think their budget was stretched
beyond breaking point ...
I'm hoping that Martin will get some fire in his belly about this issue,
as it effects so many people, and is something we all feel so strongly
about! Seems to be a postcode lottery at work, too!
PS: I would hazard a guess that your mum SHOULD be cared for
within a reasonable distance to you, for visiting. Surely there
must be some guidelines on this??? Just a thought.
Hope things go well for you, and that your Mum is as content
as she can be under the circumstances.0 -
I am submitting the care home claim today so fingers crossed. I will post here to let you know if it is successful.0

Where the primary requirement of care of an individual is assessed as being nursing care, then the individual should not be paying as this should be funded by the NHS. It is not means tested.
Where the primary care of an individual is assessed as being personal care, then the NHS does not fund this, but it is often down to the individual although it may be funded by social services depending on means testing.
Those who are not funded by the NHS or social services but in care should apply for Attendance Allowance. This is not means tested, those over 65 in need of care would qualify, and can be worth up to £77.45 per week or £51.85 p.w. at the lower rate.
You don't actually need to receive care to qualify for Attendance Allowance.
I'm not permitted to post links, but if you Google Attendance Allowance you will find the direct.gov.uk website with details.0
