Three phone 'uneconomical to repair', so we're not.

Hi All
1st post here. I have a blackberry on 3 network. 24 month contract. After 9 months it has stopped working. No water damage as the pads are white. Sent it back to them and they have said there was 'a missing component on the main electronics board'. The letter then goes on to say this can occur if the phone has been crushed, dropped or subjected to a hard impact.
Now I have examined very closely and there is no external damage to the phone whatsoever. I believe that Three are simply using this as an excuse so that they do not have to replace the phone. I believe I'm being ripped off.
I took it to an independent phone shop where they laughed and looked at the phone saying it was the same old story and they would be very surprised if the internals of the phone were damaged but as there was no external damage, he doubted it. To examine the insides would incur a cost.
Am I within my rights to cancel the contract citing their failure to honour the warranty and to cancel the direct debit.
What can I do to ensure that they cannot damage my credit rating?
Any advice appreciated.

Ask them which component is missing and where it should be located on the pcb, with proof that its should be there but isn't.0

Absolutely not. The airtime contract is totally separate from the handset. The handset was an inducement to take out the airtime contract.
You need to get confirmation from an engineer that what they wrote is tosh. You need to get their refusal to repair it in writing.
You then need to get it repaired, then issue a claim through the small claims court via MCOL for the cost of the repair, court costs, engineer's report and any other reasonable costs youcan add on.
Or you can roll over and accept it.
Stop paying and the b*****s will trash your credit report for sure.0 -

You can deal with BB directly as the handset has 12 month warranty.
If you want to deal with '3' then under the SOGA after 6 months if they refuse to repair it is you who has to prove that you have not damaged the handset.
With an independent report you can just sue '3' for the market price of the handset plus all the costs and inconvenience if they refuse to repair it.0
