    Since parking enforcement was privatised, sorry decriminalised, enforcement passed from the realm of state indictment to civil justice.

    Civil justice is about redress between two independent parties. Nothing to do with the state/crown. Civil 'due process' goes like this:

    1. Complaint (by plaintiff)
    2. Answer (from defendant)
    3. Trial (at court)

    Parking enforcement may have been decriminalised, but it is still covered by legislation, and it does not follow the process above - nor that in the examples of your grass cutter.

    (this can be verified online, try jurisdictionary.com)
    As has already been pointed out the term "plaintiff" was dropped from English and Welsh courts some years ago and replaced with the term "Claimant".

    This would not, of course, be relevant to the website jurisdictionary.com which deals with United States law. True, it too is a common law jurisdiction, but it is not England & Wales.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

  • Right, so from having read this from top to bottom I have surmised that;

    Oopsadaisy - while you disagree, you're not helping, you just look like an idiot and you're wasting my time with your stupid continuous posts attempting to discredit somebody who is trying to make a point (whether valid or not).

    FMOTL stuff is interesting but I'm yet to see anyone use it effectively in court and win. Can anyone provide evidence of this? Which cases have been fought and won and fought and lost? All I can find is theory after theory.....no solid fact that it works.

    Magna Carta, Bill Of Rights.....it's all very well in theory - but does it work? Please substantiate. Otherwise, what's the point in discussing it unless you can prove that it works?? Just saying...
