    Reading the post I would assume the OP is on IB credits, I.S to include SDP, and DLA.
    SDP she has middle rate care and lives alone

    OP you will be going over to ESA eventually, if your circumstances
    stayed the same you would get Income Based ESA
    now I dont know what group you would end up in but you would still be entitled to SDP.

    If you are IB conts, that menas IB is in payment and you go over to ESA, you have protected rights and you will keep the same rate of benefit you are on now.

    Few problems you have, if you get SDP, this is a special premium for people who live alone, so you need to get something sorted soon.

    With regard to your claim if IB is in pymnt and he moves in you will keep your IB and DLA,
    But if you have IB Credits and I.S as soon as he moved in he works full time claim closed, nut you will keep your DLA

    I get income support for incapacity. I hadn't worked long before I was told I was too ill to work. I planned on calling the benefits people tomorrow so we can then apply for notice of marriage. We have only 3 months to.apply for the spouse visa otherwise it gets complicated. It's just worrying that we may not have a lot to live off when we live together, but the prospect of being without each other when he has helped me so much is unbearable.

    Op.....I think you need to speak to CAB ASAP as its not only benefits that are the issue here but also immagration and I doubt very many of us have the advice you need.
    Just a word of caution (totally unneccessary I'm sure ) but please be sure that this man wants to marry you for 'THE RIGHT REASONS'!!! I'd hate you to be a 'means to a end'...!!

    Re getting an appointment with the CAB - have you tried your doctor's surgery?

    My Mum's & sisters GP have a CAB person come to the surgery every so often (maybe even every week), we managed to get appointments very quickly.

    I've tried my local CAB and it was impossible to get an appointment due to lack of volunteers. I'm fairly sure he's not just in it for a green card! His family have been trying to convince me to go over there and if we live together for 2 years we could apply for an unmarried couples visa, but I've got a cat and been offered therapy after being on the waiting list for 2 years.

    Our only other option is much more pricey and complicated, you see. If we did long distance, that's quite a lot to go to Oz and back for both of us. He would go back home and apply for a fiance visa and live here for 6 months and THEN marry within that time. But he would not be able to work until we got married.

    I do need to see someone ASAP though, because we have to prove that we have enough money to live off for at least 3 months and I think we need to open a joint bank account. Is there anywhere else but the CAB I can speak to? Even on the phone will do.

    Um... I don't know if you are aware of this, but you don't have 3 months, you have 10 days to get married and apply for the spouse visa.

    From July 9th he needs a minimum income of £18600 for him to qualify, if he earns 800 a month that's only 10K per year. The income requirement is reduced to £5821.40 per year NOT INCLUDING rent and council tax ONLY if you are on one of the following benefits:
    • Disability Living Allowance.
    • Severe Disablement Allowance.
    • Industrial Injuries Disablement Benefit.
    • Attendance Allowance.
    • Carer’s Allowance.
    Income support does not count from July 9th.

    If he goes back to Australia to apply for a fiance visa, the income requirements are the same, unless he has £62500 in savings.

    What?? OK, so I found out today he will earn about £1000 a month. Do you have a link I can look at? I informed the benefits people that he was living with me now so I've lost all but my DLA. I was not told this by the UKBA so this is.news to me.

    Ah, thank you. I did find the link and had a look through. So, we need some more money...
    NOW, I've just realised that since the sale of my late Mum's house went through, very soon I'm set to receive about 30,000 or more SO I would lose my income support anyway!! I totally did not think about it because the money hasn't been given to me yet.
    Do you think if I had that as an income that would work out OK? We could live off that and his income for a while, surely!

    find a free immigration advice service here. It's a criminal offence to give immigration 'advice' when you aren't qualified. Whilst I'm sure an internet forum wouldn't class as 'advice' I won't risk it- that and also I don't really know : )
