theft n. the generic term for all crimes in which a person intentionally and fraudulently takes personal property of another without permission or consent and with the intent to convert it to the taker's use (including potential sale).

Somehow I don't think TESCO were doing that !!!

Nor according to the UK legal definition which is given in s1 Theft Act 1968 (http://www.legislation.gov.uk/ukpga/1968/60/section/1).

If we're fishing for criminal liability, then a Fraud Act offence would be my choice. But again, somewhat tenuous.

CC's are now treating gambling sites as cash advances, so any transactions to poker sites, casinos , bookies etc all count as cash. Maybe you used your card in one of those. or it was a mistake that has now been rectified. Hardly a rip off we should all be concerned about.

I found this out the hard way.

The bank card I had at the time wouldn't/couldn't be accepted on the Bookmakers site I wanted to bet on.

Used my CC for the transaction, and was charged a cash advance fee.

Yet, when I refunded my winnings back onto the same card, it wasn't treated as part of my minimum payment....
Was never caught like that again...
    Life is now good :)

Normal gambling is weighted in favour of the house/ bookies, even more so when it comes to banks it seems.
  • In my experience recently Tesco bank is going down the pan!
    Incompetent, uncontactable, technically useless

Nice to see I'm not the only one with issues with Tesco Credit card. 4 months ago they lost a payment I made and then started billing me for it, including being charged twice for late payment after I'd cleared the balance less the £64 I didnt owe them. 4 letters later and they requested a copy of a bank statement since then another letter adding penalty charges for money I dont owe.
They've basically ignored everthing I've sent them

And the annoying thing is while they keep adding on penalties they're not owed, which I wont pay, I cant refer to the FOS as they havent given a final answer...or any answer.
I'm waiting for the pointless DCA letters to start next, but at least it'll be someone else I'll be informing that I'll want expenses from for the honour of responding to their letters :)

You can refer to the FOS after 8 weeks have passed or when you receive an unsatisfactory final response, whichever occurs first.

It sounds like you didn't make your complaint straight away, ie 4 months ago?

ALEX - can you post on here the exact description of all transactions on the statement? Don't need the amounts or account numbers.
You would be amazed what people on here can come up with with the proper information.
Can you also confirm that the balance was cleared last month and there are no suspicious transactions on that one which could have caused the charge on this one?

Thats what I thought but when I checked the FOS website last week they were saying that they needed a final decision before they'd act.
And my first letter went in back in March hence the 4 letters - that they've ignored
