Marshall Hoares Bailiffs - Unfair threats & charges

  • We get these all the time. Have requested a full breakdown of what I owe but strangely get nothing from them because they know most of the money they are asking for is illegal charges! I've been advised to only pay my original loan, one months interest and the first default fee, and tell them if they want anything else to take me to court. I can't see that happening. I haven't paid anything yet because they refuse to accept any payment proposals but the amount I believe I owe them is sat in my ISA so I can pay in full when they play fair! I kind of want them to take me to court because at least then something is happening instead of constant phone calls, texts and emails!

  • just contact national debtline for free and they will help anyone with debt and and how to deal with bailiffs dont go to debt management companies as they are a waste of money if you cant afford your debts you can apply for a debt relief order which will cancel all your debts after 12 months but you will have bad credit for 6 years but this only works if your on benefits. But if you are employed you can get a free debt management plan through national debtline which is ideal as any money paid a 100% of it goes to paying of your debts and after you fill in an expenditure form you will be offered a plan that suits what you are able to pay as for marshall hoare bailiffs ive been waiting 10 weeks for someone to come to my door and have sort advice where if i havent been to court thers nothing they can do you can politely ask them to !!!! off:T
  • I have been receiving phone calls and emails from MH, the phone calls are every day, I am not the person they are looking for how do i stop them from harassing me, i do not want anyone to come knocking my door, but can't seem to email them?
  • Toothfairy (paycheck credit) applied to my husbands bank 26/1/12 at 3 clock in the morning & took 23 transactions of £36. We only have an OD of £150, but all transactions where paid so we had a fortune in bank charges aswell. Bank charged £8 per transaction every 5 days (3 weeks) I applyd for the loan back & was giving £300 by toothfairy (speedy credit), this i had no intensions of paying back due to the bank charges they cost me. By the way my husband had no idea i had this loan until he went to bank & he was OD by £700 he had just got a bonus from work,
£400 in 6 weeks cost us £1480, but the £300 i got (1/2/2012) i have not paid back stands at £3225.
There are now just starting ti send me emails from marshall hoare.
  • I was always getting letters from toothfairy finance and MH bailiff. I rang MH bailiffs to tell them it was not me who took the loan out as it was my ex boyfriend, I had to change the details they were given as he said I had been working in boots for 46 years. When I rang them to say I am only 21 the person who I spoke to said "I think he was meant to have put 46 months". even though I said it was not me who took it out they still insisting I pay, I set up to pay 50 a month and now a day before the payment is to come out I get a text message and an email off them. If anyone can help me to make them realise it is not me who applied for the loan I would appreciate it so much
  • The OFT are currently investigating the companies as all tooth fairy finance and marshall hoares, speed credit, easy finance club, web loans processing ltd & Northern Debt Recovery are owned an run by the same person and all at the same address.

Let them know you are in talks with the OFT, FOS and CAB however do this by email - you will of course find this hard to do unless your me and search for web loans processing they basically run all the companies on this site they have a ' media enquires ' email address use it!! although you get an automated response emails are picked up someone called Michael Lapides responded to me if this doesn't work try someone's firstname.lastname@webloansprocessing.co.uk

I genuinely had to take a drop in earnings because of doing less hours they asked for a payslip which i provided and i have also said i will only pay £348 which is my loan plus one months interest, because i mentioned i was in talks with all these government agencies they agreed to so i am posting 3 post dated cheques to them like it or lump it as its not a priority debt i could get away with paying them £1 a month, i would suggest being careful how you send money to them as you do not want to give them unauthorised access to your bank account.

In regards to Marshall Hoares please do not let anyone in, they are usually empty threats and will never come round however i have read one or two cases of them turning up if they do please call the police they have no right to be there or enter also do not be tricked by ' can i use the toilet or phone' they are not even bailiffs they are door step collectors who basically try and persuade you to give them money or pay the debt do not enter into conversation shut the door. Again as i have said if they don't leave call the police immediately. They are all the same company not out sourced as i have said.

They have Never Ever taken anyone to court as there fees are deemed unlawful.

Please i stress email the OFT they are collecting evidence to get them shut down! :D

    complaint

Ms D complains that Marshall Hoares Bailiffs Limited (MHBL) added unfair charges to her account
and harassed her in pursuit of a debt.

    our initial conclusions

Our adjudicator recommended that the complaint be upheld. She found that MHBL added charges
to this account after Ms D told it of her financial difficulties; she did not consider this to be
reasonable. Our adjudicator also found that MHBL’s communications with Ms D did not meet Office
of Fair Trading (OFT) requirements. She recommended that it reduce Ms D’s outstanding debt to
£359 and pay Ms D £200 to reflect the distress and inconvenience this matter has caused her.

    my final decision

I have considered all the available evidence and arguments to decide what is fair and reasonable
in the circumstances of this complaint. Having done so, I uphold this complaint.
Ms D was lent £200 by a company affiliated to MHBL in April 2012. Ms D suffered financial
difficulties and was unable to repay the debt as planned, incurring late payment charges. She
informed the lender of her situation in June 2012 and tried to negotiate an affordable repayment
plan. Her lender rejected this and referred the debt to MHBL, adding further charges to the
account. Both companies sent aggressive emails and texts to Ms D demanding repayment.

I find that MHBL added unreasonable charges to Ms D’s account after she said she was in financial
difficulties. I am also satisfied that MHBL’s communications did not meet the requirements of the
OFT’s debt collection guidance by “putting undue pressure” on Ms D. It follows that MHBL should
    compensate Ms D for this.

My final decision is that I uphold this complaint and I order Marshall Hoares Bailiffs Limited to pay
redress as set out in full overleaf.

    ombudsman notes

My final decision is that I uphold this complaint and order Marshall Hoares Bailiffs Limited to:

     reduce Ms D’s outstanding debt to £359;
 agree an appropriate and affordable repayment plan with Ms D for this debt; and
 pay Ms D £200 for the distress and inconvenience this matter has caused her.
