    Ms D complains that Marshall Hoares Bailiffs Limited (MHBL) added unfair charges to her account
    and harassed her in pursuit of a debt.

    our initial conclusions

    Our adjudicator recommended that the complaint be upheld. She found that MHBL added charges
    to this account after Ms D told it of her financial difficulties; she did not consider this to be
    reasonable. Our adjudicator also found that MHBL’s communications with Ms D did not meet Office
    of Fair Trading (OFT) requirements. She recommended that it reduce Ms D’s outstanding debt to
    £359 and pay Ms D £200 to reflect the distress and inconvenience this matter has caused her.

    my final decision

    I have considered all the available evidence and arguments to decide what is fair and reasonable
    in the circumstances of this complaint. Having done so, I uphold this complaint.
    Ms D was lent £200 by a company affiliated to MHBL in April 2012. Ms D suffered financial
    difficulties and was unable to repay the debt as planned, incurring late payment charges. She
    informed the lender of her situation in June 2012 and tried to negotiate an affordable repayment
    plan. Her lender rejected this and referred the debt to MHBL, adding further charges to the
    account. Both companies sent aggressive emails and texts to Ms D demanding repayment.

    I find that MHBL added unreasonable charges to Ms D’s account after she said she was in financial
    difficulties. I am also satisfied that MHBL’s communications did not meet the requirements of the
    OFT’s debt collection guidance by “putting undue pressure” on Ms D. It follows that MHBL should
    compensate Ms D for this.

    My final decision is that I uphold this complaint and I order Marshall Hoares Bailiffs Limited to pay
    redress as set out in full overleaf.

    I am in a very similar situation with "toothfairy finance". I have recieved in total 4 emails from "Toothfairy finance" and one from Northen Debt Recovery pretty much saying the same as the other 4.
    The emails are quite worrying and I also received a letter today (dated 17th June) saying exactly the same as the emails I have been receiving. I spoke with CCCS this morning and they have put my mind at rest but I just want to get this all sorted :(

    I spoke with Northen Debt Recovery as they said they were not going to accept the offer CCCS offered them and they said they would accept £40 a month (my total balance is £626 although my original loan was for £400) however they would be putting an £400 on my balance if I do not pay in full by 27th June!!
    I spoke with CCCS straightaway however the department I needed to speak to was closed (phoned just before 7pm).
    I will phone them again tomorrow morning, but I be sending the letter Chippy very kindly posted on here also the letter outlining that I do not want home vists (I know I can just shut the door and call the police but I am worried someone else may open the door (housemate).

    Really wish I had done some research into this so called company!

    Did you get very far with this? I am in the exact same position at the moment, all the emails, threats etc and now saying I owe £1460.....on a £100 loan.

    I have made an offer of payment but the have rejected it.

    Anyone had any luck with this? Iv worked so hard to clear all these stupid PDLs and other debts and have had quite a bit of success with most, having managed to get payments plans in place and negotiate reduced settlements, but toothfairy/speedcredit are the only ones refusing to budge.

  • I am in the same situation, have lost count the amount of phone calls, text messages and emails I have had from NDR and MHB which I believe to be both the same company. Threatening bailiffs to my door, court action etc. I have contacted them several times explaining I am on a DMP and I know my debt charity have also contacted them but they still harass me.
    Now when I try emailing the company it won't let me. I refuse to phone them as I want everything in writing. This is all over a loan with tooth fairy finance which was for £200. It's horrible to receive such threatening emails and texts.
  • I received a visit from a debt collector about the debt I owe to speed credit. The loan was for £300. My husband had problems with his work and we got behind with the payments. The debt was sold to Marshall hoare who kept adding interest. I eventually went to a debt management company who made an offer. They accepted to offer of payment but are still hounding me for the full amount. I now owe £2600 on a loan of £300. What do I do. I'm really stressed with this all. I haven't told my husband, he would go crazy. They are adding at least £100 every week. Help!!
  • Right then most of what I am going to write may have already been said previous, but with a twist...

    Marshall Hoares Bailiffs Ltd status is Non-Trading???

    I have been in receipt of emails from MHB & NDR for well over 18 months, and in that time I have noticed a pattern... email 1, courteous and polite. email 2, Advice as to what will happen should you not pay and email 3, threatening and aggressive and sometimes a 4th... which is much the same as the 3rd.

    Of course at this point they have scared the recipetent into paying, or to be worried that much they go to debt management companies.

    So what happens after the 4th email/letter they start over, and so continues in a loop.

    I used to get threatening phone calls until one day I advised them that I am recording this conversation and from that point on never got another call from them.

    I owe Tooth Fairy £2246 for a £200 loan one might ask how this can be? Well lets look at another payday loan company Payday UK which I owe them £212 for a £125 loan which they have been trying to collect since December 2010.

    So whats the difference between the two? Well NDR/MHB/TF are all registered same address and are in fact the same, Now whilst writing this have learned that NDR client is ToothFairy Finance Ltd Which has never existed as a company neither has ToothFairy pay day loan and if they don't exist as a company???

    But hold on to your hats... CIM TECHNOLOGIES LIMITED registered address is the same. In fact NDR/MHB/TF are shell companies for CIM... What brings me to this? both NDR and MHB have £0 assets and net worth is £0, whilst CIM's 'cash at bank' of £24,616, 'liabilities' worth £489,903, 'net worth' of £-168,805 and 'assets' worth £341,098.

    Little under 2 years ago I took out a pay day loans from all of them, high street/online/phone think a total of 20 PDL's. Not one did I pay back.... (Sudden gasp from the reader)

    A PD loan is an unsecured loan and as such is not governed by any regulatory body. So a creditor cannot pursue a debtor through the courts or bailiffs.

    Should anyone feel they want to challenge me on this, then read on... for 7 years ending last year I owed large financial institutions including Barclays more than 100k. So what happened? Nothing, just letters and phone calls. What about my credit score? Well yes what about that! 3 years ago I managed to get credit cards and a £5,000 loan from Tesco, 2 years ago it was PD loans 18 months ago managed to open a new bank account with a £1000 overdraft.

    That's exactly what happens with TV Licensing. :p

    When you've had 7 cycles of letters, the threats become funny, rather than worrying.
