Forgive me my selfishness, I'll go down this weekend and sort it out.
None of the Statutory remedies will apply here, change of mind/suitability is at the discretion of the vendor - and a 2nd hand phone has no value.
What surprises me is that he assumed (wrongly) that because he could not get a battery for his phone from that SINGLE source, that was and end of the matter. It is rare to Phone shops to sell ANY batteries, unless there was a particular model that sold enough quantities to warrant them holding spares. Since the battery will last at least a year (or two) they are unlikely to have them for current models, unless the type has be used in earlier models.
I can still get a battery for my 8 year old model, and it still works fine. The solution to your problem is to ask wether he wants his old phone working, if so get a battery for him by entering the model number in an eBay search box - or the phone Model Number, usually shown under the battery. Package up the Samsung Galaxy and then sell it privately - you'll probably get £50 to £90 for it as it is almost new. The Galaxy is an acquired taste, and he'll probably not know how to answer an incoming call either (as this is less than intuitive).
The the old phone is beyond redemption, look out for any made by Doro - these are designed for those who just want a basic handset without the hassle, and have large buttons and big screen texts.
