    Hi All,

Really starting to shift with my bank charges. However, I`m trying to claim back late payment charges on my mortgage and have recieved a letter today from Northern Rock stating that all charges are fair and that "the charges do not represent any form of damages for breach of contract and were simply charges for service. You were clearly and unambiguously notified of the charges, prior to entering the mortgage agreement"

    So essentially, get lost.

there are bits and bobs of other legal mumbo jumbo and I get the impression that the use of terms like "clearly and unambiguously" are designed to throw me off the scent.

Is anybody else in a similar situation and what success stories do we have with Northern Rock?..........

Any advice on how to take this further would be greatly appreciated....

    Cheers Jimmy

Got to wonder what service they were providing in charging you for this. Personally I would go to the court stage with this and let them explain to the court :)
  • me too. just looking for some kind of reassurance.

do you think it`s wise to give them a call first.

  • I am in a similar position, having received the same letter today. it does concern me that they are asking me to respond to certain points, with a lack of response being taken into account at court...?! Should we reply or ignore this and take them anyway?
  • We were wondering wether to start the ball rolling with Northern Rock too. We have just asked for money back on their Credit Card (now called Co-operative) but haven't done the mortgage fees and charges yet.

Keep us updated if you get any further

  • I received notice that the court papers are served and that Northern Rock intend to Contest the claim signed by their solicitor. Is this normal procedure or should I be concerned as my claim was only for £700 and wondered whether they feel they have good reason to fight a small amount.
  • Of corse they contest it, they have to act like they don't think they are in the wrong ;)
I received my papers for Lloyds TSB t'other day and they are my third now and is only £100 but they have contested and think they will "defend"
Bunch of royal !!!!!! aren't they, paying solicitors to do nothing and pretend to defend cases when all along they will pay up anyway, I am sure they could save themselves a lot of money by not paying these wasters :rotfl:
Good luck on getting your cash(not that you'll need it)

Nice to know that the letter my Dad got from Northern Rock is the standard reply! They really do think that if they are condescending enough people will go away. Well he isn't, he's told them he won't be explaining anything to them and that they have until Thursday to pay up or he'll start the court proceedings.

I have searched the success stories but not found many with Northern Rock. I have had a current account with them for 15 years and am claiming over £700 of charges. I have just received a reply to my first letter, and they are saying the charges "do not represent any form of damages for breach of contract" blah blah. I suspect this is the standard response and I should continue?

If anyone has any recommendations I'd be very grateful; also not sure whether to pursue through the courts or Financial Ombudsman Service. It does get a bit scarey at this stage!!
  • I am having a tussle with A&L at the mo, you will find they bluff and posture at every oportunity. I have ignored it and I am making good progress. If they can put people off with a snotty letter then they will - think about it, it has only cost then about £2.00 in admin to save £hundreds in returned money.... so they try hard to put you off but DO NOT BE.

    All the best!

Alice carry on with your claim! My Father is on his 3rd letter from Northern Rock now (they all sound as bombastic). He's about to issue in court and NR are demanding he tell them what he's doing but they can just wait for a surprise in the post. ;)
