    1. It's a communal responsiblity to clean communal areas.

    2. Is the house licensed as an HMO? If not you have leverage over the landlord as the penalties for not registering are high.
  • No. Basically i came looking for advice not an opinion. I can take what i want from an opinion.And say what i choose once said opinion is recieved.

    I think the majority who posted on this thread cannot tell the difference between advice and opinion.

    As for adult world ? Im 37 i think that qualifies as being an adult. Shocked ? well i do not have to give my life story over in a thread to explain how i got here in the first place.

    Check the Forum rules - what gets posted on here is suggestions, guidance, opinion etc - *not* advice.

    The others are right however that the failure of your house sharers to contribute towards the cleaning is not the LLs responsibility - was there an inventory completed at the start of your tenancy ( signed by both you and the LL)?

    You have said that there are 4 of you living in the house:does the property have 3 or more storeys? Go onto your local Council's website and check their HMO licensing rules - there is mandatory licensing plus additional/selective in certain areas.

    If the property is not licensed, and should be, you may like to know that Ts can apply to have their rent repaid for the time in which it was unlicensed.

    Get onto mydeposits, DPS and TDs websites and check the status of your tenancy deposit.

    I am going to take a slightly different stance to my fellow posters. IMHO the landlord does have some responsibility for the cleanlines etc of the communal areas, as per sections 7 & 8 of the
    The Management of Houses in Multiple Occupation (England) Regulations 2006. http://www.legislation.gov.uk/uksi/2006/372/contents/made

    In some HMOs the landlord pays for someone to do the work, in others it is imposed as a 'shared responsibility'. However, if whatever method the landlord chooses doesn't work, then it is he who is responsible.

    In this instance, if cleaning of communal areas is part of the tenancy ageements, then the landlord needs to enforce the tenancy agreements (which could, of course, involve s21s). If it isn't in the tenancy agreement then it is simply a case of the landlord not having done anything at all to comply with these regulations.
    Life should be a little nuts; otherwise it's just a bunch of Thursdays strung together.

    I don't think this newby deserves any suggestions, guidance, opinions or any etceteras either after having been so rude.

    The only way to get proper, qualified advice is to seek out a professional and pay them for it.

    Being rude to strangers on the internet is sooo very primary school. I think you should try to grow up.

    Re the deposit - yes make sure it is registered by contacting the three sites. If it isn't then he is a dodgy landlord as it is a legal requirement

    Re the cleaning - not his responsibility I am afraid. I own an HMO that is rented by the room. The tenants used to have problems with a lazy co tenant. They have now hired a cleaner to come in once a week and peace is now restored. Could that be something to suggest to your housemates e.g. either we all do a bit or we get a cleaner and all pay for it - if the alternative is to put their hands in their pockets they may help you

    If a poperty is only 2 storey and upto 6 people live in it then it may not require HMO licence just HMO standards IE smoke alarms, fire exits ( windows and doors) EPC. gas safety certificate.electrical safety check
    More and more councils are now introducing licence for all HMO,s

    OP if the landlord hasn't registered your deposit then take the way out that people took before the registration schemes came in - don't pay your last months rent on moving out.

    And while you may think this is the wrong thing to do being £50 out of pocket is better than being £500 out of pocket plus the time spent and money going through the courts in attempt to get most of that £500 back.
    I'm not cynical I'm realistic :p

    The major gripe seems to be about the deposit,that the OP seems to think others in the house aint payed.

    As for cleaning....if you can't beat em join em,lay off the cleaning and see what comes of it.
