Dodgy Landlord

Hi everyone

I need some advice if I may ask.

My situation is a not straight forward so please bear with me.

I currently live in a shared house (wouldn't recommend,only to students)

I moved in November 2010 and paid the Landlord 500 pounds deposit

I have an assured short hold agreement for 6 month from then it has rolled on monthly.

I think the landlord has not protected my deposit as i never received any documentation regarding this

I have also discovered that another tenant who has moved in 4 weeks ago has not paid any deposit or any rent.
I know this by having what I will call a trick discussion with this tenant.

There are 4 of us in the house hold and I know of one other who has had no deposit scheme documentation.

Also because this is a shared house the kitchen dining room hallway garden etc all instantly become communal yet no one cleans these apart from me.


I have challenged this but Landord id not interested and say it's up to every one in house to rota it.But surely this is the landord responsibility?
I do not rent these areas only a room,right? or wrong?


there are many other thing that this so called Landlord fails on
I'd be here all day.

wht I really want to know is should have my deposit been protected in this shared house set up? or are there different laws concerning this?

by the way for those reading and judging yes I have been here 2 years nearly and yes I could have challenged this earlier but its not so easy when if above issue challenged you feel like you risk losing the roof over your head,so please just unbiased answers would be appreciated

    You use the kitchen etc? You make it dirty? Unless your tenancy agreement specifically states that the landlord will provide cleaning services (unlikely) then it is up to the 4 of you to do this. Sharing a house is always difficult - you just have to discuss/agree who will clean what/when.

    Do you share the loo? Who buys the loo paper etc? Do you share teabags? These are just things to agree between you. Have a 'house meeting' and discuss!

    If your deposit is not protected, write (WRITE A LETTER) to the landlord at the address "for the serving of notices" which should be on your tenancy agreement, asking him to protect your deposit and inform of the scheme details. See here.

    The other tenants' deposits/rent are not your business (assuming this is an HMOs and you each have seperate tenancy agreements).

    It may have been many years ago, but I well remember sharing houses with other students, and young workers when I started work.

    Sharing cleaning was the number 1 cause of disputes!

    Sharing bills was number 2! If this is an HMO I'm guessing the LL pays the council tax (he has to) and possibly the gas/electric too, so that's one cause of dispute with your housemates removed.....!
  • Quite right LL does pay council tax And gas / electric. I think at £450 pm for a pokey room more than reflects that this should be the case. My dispute is not with fellow tenants - there is little i can do if my standard of cleanliness i far superior to theirs. But the fact still remains that these areas are communal - if i had it stated in my AST that i have sole use of the bathroom I would not question who cleans it.It would be me.This is a grey area as far as im concerned. And an area i will not deplete any more energy trying to battle. My main area of concern is my tenancy deposit.......and what ive seen on other forums its not uncommon for private landlord to be over looking this. thanks for your reply .

    Not a grey area at all.

    They are communal areas, shared by all those in the property.

    So responsibility for maintaining those areas, which are used by all tenants, lies firmly with ... all tenants who use the areas!

    Your deposit needs to be protected. G_M has told you how to proceed with that issue.

    Whilst I agree it should not fall solely on your shoulders to clean up the communal areas, it certainly does not fall on the landlord. Your 'issue' I am afraid is with the other tenants.

    Its simply a peril of sharing a house.

    If you are paying £450 a month for a small room in a DIRTY shared house with dirty lazy tenants why not buy/rent a nice clean one bed flat or even a house.
    Every summer we clean and repaint/refurbish student houses and 6/8 weeks after the students move in it looks like a squat.
    You pay your money and make your choice

    I'm taking a wild guess here, and I could be wrong by a long shot, but maybe he can't afford it?

    To the OP: Your issue with the landlord is the deposit. Do as G_M said. First, check on the websites of the 3 deposit protection schemes if yours has been protected.

    As for the cleaning, it's up to you and your housemates. I sympathise.

    I started this thread looking for advice the majority of what i got was personal opinion on my situation .
    you must spend your sad little live logged in waiting for the next victim!
    spoon out your own style of "advice" and pat yourselves on the back!

    It getting harder and harder to find a quality forum these days.....full of self righteous, opinionated,retards.
    If you had read my initial post properly you would have seen i was looking for ADVICE. Which i grant you i have recieved ,but not without the !!!! to go with it.

    The "issue" as it stands is NOT with tenants. I can only assume the majority here are LL hence the reason so defensive.

    I dont need advice from a landlord. Particuarly ones that are not playing by the book.
    I suggest all those who have aired an opinion on my situation here leave it there.Those who gave advice i thank you.

    it should be quite obvious which people fall in what catergory.

    So, basically, you came here to ask a question, didn't get the answer you wanted to hear and now you're throwing your toys out of the pram.

    I'm afraid the others are correct, you need to speak to the other three self centred brats and work out a cleaning rota. That's how it works in the adult world.
