Solicitors made a mistake and now want us to pay extra?

  • Oh, and we have to pay by Bank Draft which is another £15 not to mention the time off work and inconvenience to go 13 miles out our way to our bank all because of THEIR mistake.

    You don't have to pay by bank draft. Assuming this is a genuine error on their party and the money really is owed, talk to the solicitors to agree a repayment plan

    To be honest in my opinion, Professional or not, we all have to pay land registry, you should have paid it. You knew you had to pay it and upon receiving the final bill didn't query it. You owe it so I think you should pay it. They aren't adding random fees on to your bill to rip you off...

    OP, you owe the disbursement - it's a legal third party fee which the solicitors are not making profit on - and therefore you are liable to pay it.

    Out of interest, presumably you got an initial quote from them and it was included in that quote?

    However, I would suggest writing to the partner in charge of complaints (you will find the details on the initial client care letter you received from the firm) and state a) that you relied upon the completion statement in doing your budgeting for your move; b) you you wish extra time to pay as you cannot conjure up this at a few days' notice; c) you wish to pay by cheque rather than be put to the extra expense of a bank transfer fee owing to their error; and d) compensation for the stress and distress caused by this late notice.

    If they refuse any of your requests, you can then go to the Legal Ombudsman with your complaint, but you do need to have exhausted the internal route first.

    That petrol purchase analogy's bunkum.

    It's more like getting your car serviced/repaired.

    The garage says the service is £100 + parts + labour

    They tell you that you need new brake pads; oil+filter ; new exhaust and 2 new tyres.

    The bill shows everything, but the tyres are listed as £0.00

    You pay the bill.

    The garage contacts you later to say - the tyres were not included in the bill, can you pay for them please?

    Morally - you owe the money.
    Legally - they could probably sue for it

    Sensibly - complain and ask for a discount off their fees, say £20? for goodwill? :cool:

    how does the final figure compare to the amount given in your original quote? If the land registry fee was quoted at the outset you should have budgeted for it. If not, I don't see how they can expect you to be liable if you were never quoted for it.

  • Would you prefer not to have your purchase not registered? Although this isn't possible, land registry isn't optional.

    If they had put it on your completion you would have to have paid it.

  • They aren't asking you to pay extra. They are asking you to pay what you owe them for the work that you asked them to carry out on your behalf.

    We paid the £5843.03 to complete. To be honest this is our first house so we have no idea of what is and isnt needed. We just assumed that when they say this is how much you need to pay for it to be complete it would be.

    Now out of the blue they ask for another £200 which to be honest after using all our savings for our house (first time buyers) and haveing to buy everything from forks to cushions is alot of money, and they are DEMANDING it be paid within 14 days.

    It just seems so maddening that they can do this. They also charged us there "fee" on top of everything, which to be honest should be discounted as this clearly wasnt done properly or professionally, but rather lax if they can make such a mistake as not charge for something as important as this!
